There Are Naughty Companies That Hold Employee Certificates, Ministry Of Manpower Wants To Issue Circular

The Ministry of Manpower (Kemnaker) will issue a Circular (SE) regarding the ban on the detention of employee diplomas by the company.

Deputy Minister of Manpower, Immanuel Ebenezer Gerungan said this circular letter would later be issued on Tuesday, May 20 by the Minister of Manpower Yassierli.

"So tomorrow it is very likely that we will immediately issue a circular. For the beginning, a circular letter. Tomorrow, the Minister will deliver it directly. So we will speed everything up," he told the media crew in Jakarta, Monday, May 19.

Noel, Immanuel's nickname, said that this step was a real action by the Ministry of Manpower before issuing a Ministerial Regulation (Permen) regarding the detention of this employee's diploma. Noel said that the process of issuing Oermen would take time so that a circular would be issued first.

"This fast is the SE first. Because the Permen takes a long time, yes. Well, there must be a harmonization process (rules) and so on. So the most likely one is for the temporary SE," he continued.

Noel said that the detention of this employee's diploma was one of the focuses of the Ministry of Manpower because there were still many field findings where business actors withheld employee diplomas which were then asked for a ransom of a sum of money. This is also a complaint from a number of workers who communicate directly to Noel through the Labor Tanya Wamen (BTW) which was just inaugurated today, Monday, May 19.

In addition to the detention of diplomas, he continued, there were findings in the field related to the phenomenon of diploma sugary with a varied price of between Rp. 2 million, Rp. 10 million to Rp. 35 million. According to Noel, this is the behavior of extortion by employers to employees.

"We consider it a form of extortion. Holding back diplomas is also a form of crime. There is a Criminal Code article," he said.

Noel also gave a strong warning to entrepreneurs who detained diplomas and demanded a ransom of some money. Neol admitted that he did not hesitate to criminalize business actors under the article of extortion.

"So tomorrow we will most likely immediately issue a circular," said Noel.
