Apple Loses Again In Brazil's 'iPhone' Brand Fight

JAKARTA Apple got an unfavorable result in Brazil's court ruling regarding the iPhone brand. In the latest report, federal courts are known to side with other iPhone brand owners.

This decision is a setback for Apple in defending its trademark. Reporting from Brazilian media, O Globo, federal courts made unanimous decisions by providing full support to Gradiente, the country's home company.

The decision was unanimous with the acquisition of 5-0. With the exit of this latest decision, the revocation of the 'G Gradiente Iphone' trademark was canceled. At that time, Gradiente's rights were revoked because the brand was no longer in use.

Although the previous decision has been lifted, Apple still holds the exclusive rights of iPhone products in Brazil. If this decision is upheld by a higher court, Apple will find it difficult to defend its trademark.

The iPhone trade rights race has been going on for more than a decade. Judging from his history, Gradiente was indeed the first company to issue an Iphone name.

The company, now known as IGB Eletr Marijuca, filed for the G Gradien Iphone trademark in 2000. New trademark registration was obtained in 2008, a year after Apple launched its iPhone globally.

Apple is also doing the same thing, namely registering the iPhone trademark in the country. However, the trademark application was rejected because the brand had been claimed by Gradiente. For this rejection, Apple finally sued Gradiente.

Apple tried to seize the iPhone trademark from Gradiente because the electronics company had not released a cellphone with the name iPhone at that time. After the lawsuit was filed, Gradiente just released his cellphone.

This trial was slow because the two companies won and lost each other. Apple is trying to own the iPhone brand exclusively, while Gradien fights for shared rights to the brand.
