KPK Will Review The BUMN Law On Directors-Commissioners Not State Administrators

JAKARTA - The Corruption Eradication Commission (KPK) said it would review Law Number 1 of 2025 concerning State-Owned Enterprises (BUMN Law), particularly regarding the substance that the directors and commissioners in the regulation are not state administrators.

"There needs to be a study, both from the Legal Bureau and from the Deputy for Enforcement, to see to what extent this rule will have an impact on law enforcement that can be carried out at the KPK," said KPK spokesman Tessa Mahardhika Sugiarto quoting Antara.

Tessa explained that studies were needed given President Prabowo Subianto's commitment to minimize, even eliminate budget leaks.

In addition, he said, a study was needed so that the KPK could provide input to the government regarding improvements and improvements to a statutory regulation, especially those related to eradicating corruption.

Meanwhile, he stated that the KPK was the executor of the law. Thus, law enforcement related to criminal acts of corruption must not leave existing regulations, including the directors and commissioners of SOEs in the BUMN Law.

"If it is not currently a state administrator that can be handled by the KPK, then of course the KPK cannot handle it," he explained.

Law Number 1 of 2025 is a statutory regulation that has only been stipulated and is valid since February 24, 2025. The law changes Law Number 19 of 2003 concerning SOEs.

Article 9G in the latest BUMN Law reads: Members of the Board of Directors, Board of Commissioners, and Supervisory Board of SOEs are not state administrators.

On the other hand, one of the objects that the KPK has taken action against is a state administrator who commits a criminal act of corruption.

In Article 1 paragraph (2) of Law Number 19 of 2019 concerning the Corruption Eradication Commission, state administrators are state officials who exercise executive, legislative, or judicial powers, and other officials whose functions and duties are related to state administrators in accordance with the provisions of the legislation.
