Indigenous Justice: Suspect Of Chicken Curi In Central Lombok Fines IDR 490 Thousand, Cases Stopped By The Kejari

LOMBOK - The District Attorney (Kejari) of Central Lombok, West Nusa Tenggara (NTB) approved the request for the settlement of the chicken theft case based on the restorative justice mechanism (RJ).

"We are resolving the case of chicken theft by RJ," said Head of Intelligence at the Central Lombok Kejari I Made Juri Imanu in Central Lombok, Antara, Friday, April 25.

One case that was approved to be resolved was through a restorative justice mechanism, namely against the suspect PI from the Central Lombok District Attorney, who was suspected of violating Article 363 paragraph (1) 3 and 4 of the Criminal Code regarding theft by weight.

This case began on Wednesday, February 12, 2025 at around 22.00 WITA, when AJ (DPO) came to the house of the suspect PI in Dasan Buah Hamlet, Sukarara Village, Jonggat District, and invited him to steal chickens in Buncanalang Hamlet.

"Because they only work as odd jobs without a fixed income and need money for their daily needs, PI finally accepts the invitation," he said.

Then on Thursday, February 13, 2025, at around 02.00 WITA the suspect and AJ (DPO) departed from the suspect's house on foot to the house of the victim HG and stole 7 chickens and 1 3-kilogram LPG gas cylinder belonging to the victim.

"The prosecutor appointed a facilitator to resolve the case based on restorative justice," he said.

During the peace process, the suspect admitted and regretted his actions and apologized and the victim had forgiven the suspect, but there are conditions that must be met by the suspect in accordance with the rules of the Sukara Village (adat law).

Based on the results of the village deliberation, an agreement was obtained, applied to the suspect's actions, namely paying a fine.

"So the suspect must pay a fine of Rp. 490,000 to the Sukara Village apparatus, which then the fine money will be used for the benefit of the community," he said.

After carrying out an internal exposure with the West Nusa Tenggara High Prosecutor's Office, the request for termination of prosecution based on restorative justice in the settlement of the case handling has been approved with considerations, among others, having carried out a peace process where the suspect has apologized and the victim has forgiven.

"The suspect has never been convicted and it is the first time the suspect has committed a criminal act," he said.

The threat of a fine or imprisonment is not more than 5 (five) years and the suspect promised not to repeat his actions, as well as the peace process on condition that it has been carried out voluntarily by deliberation for consensus, without pressure, coercion, and intimidation.

"Sociological and community considerations are positive," he said.
