Bahlil Calls The TNI Bill Process To Ratification Already In Accordance With Procedures

JAKARTA - Chairman of the Golkar Party Bahlil Lahadalia assessed that the approval of the ratification of the TNI Bill into law by the DPR RI had gone through the proper procedures, so it was appropriate to be supported.

According to Bahlil, his party has followed the process of discussing the Draft Law on Amendments to Law Number 34 of 2004 concerning the Indonesian National Army or (TNI Law) from the start from internal factions to Commission I of the DPR.

He believes that what the members of the council have discussed about the TNI Bill have considered much for the good of the nation.

"Everything has good intentions," said the Minister of Energy and Mineral Resources.

Previously, the 15th DPR RI Plenary Meeting for Trial Period II for Session Year 2024 2025 at the parliament complex, Jakarta, Thursday, approved the Draft Law on Amendments to Law Number 34 of 2004 concerning the Indonesian National Army or the TNI Bill to be ratified into law.

"Can the Draft Law on Amendments to Law Number 34 of 2004 concerning the Indonesian National Army be approved to be passed into law?" said the Speaker of the Indonesian House of Representatives, Puan Maharani, who was answered to agree by the meeting participants at the DPR building, Central Jakarta, Thursday (20/3).

The agreement with the TNI Bill was witnessed by the Minister of Defense Sjafrie Sjamsoeddin, Minister of State Secretary Prasetyo Hadi, TNI Commander General Agus Subiyanto, and the ranks of the Ministry of Law and the Ministry of Finance.

In the TNI Bill there are four points of change, the first is Article 3 concerning the position of the TNI which remains under the president regarding the deployment and use of force. Meanwhile, defense strategies and administrative support related to strategic planning are in the coordination of the Ministry of Defense.

Then Article 7 concerning military operations other than war (OMSP), which increased the scope of the main tasks of the TNI from 14 assignments to 16 tasks. The addition of the two main tasks includes helping in tackling cyber threats and helping in protecting and saving citizens, as well as national interests abroad.

Then the third change, namely Article 47 concerning civil office that can be filled by active TNI soldiers. In the old law, there are 10 fields of civil office that can be filled by active TNI soldiers, while the bill has increased to 14 fields of civil office.

The position can be filled by active TNI soldiers only based on a request from the ministry/institution and must comply with applicable regulations and administration. Apart from that, the TNI must resign or retire from the army service if it is to fill civilian positions.

The last change is Article 53 regarding the extension of the pension age for soldiers at all rank levels. The retirement age limit for non-commissioned officers is 55 years, while officers to the rank of colonel have a retirement age limit of 58 years.

For high-ranking officers, the service period is extended, especially for four-stars, namely 63 years and a maximum of 65 years. Meanwhile, in the old law, the military service is up to a maximum age of 58 years for officers and 53 years for non-commissioned and non-commissioned officers.

"We emphasize that the amendment to Law Number 34 of 2004 concerning the TNI remains based on the values and principles of democracy, civil supremacy, human rights, and fulfills the provisions of national and international law that have been passed," said Chairman of Commission I DPR RI Utut Adianto when presenting the bill report.
