The Verdict Of The Ex-Director Of Finance Of PT Timah Is Increased To 20 Years In Prison
JAKARTA - The DKI Jakarta High Court has increased the verdict of the Finance Director of PT Timah Tbk. for the 2016-2020 period, Emil Ermindra was in prison for 20 years related to the corruption case in the management of tin commodity trading in the mining permit (IUP) area of PT Timah in 2015 '2022.
Chief Judge Artha Theresia stated that the Panel of Judges had increased the verdict after receiving a request for an appeal from the public prosecutor and Emil for the sentence handed down earlier by the judges of the Jakarta Corruption Court (Tipikor).
"Change the decision of the Corruption Court at the Central Jakarta District Court which was asked for an appeal regarding the length of the sentence imposed and the additional penalty for replacement money," said the presiding judge in a copy of the appeal decision reported by ANTARA, Thursday, February 27.
Thus, the criminal sentence imposed on Emil was also increased to Rp1 billion, provided that if the fine was not paid, it would be replaced (subsidiary) with imprisonment for 6 months.
In addition, the Chief Judge stated that the Panel of Judges also added Emil's sentence with an additional penalty in the form of payment of replacement money, provided that if it is not paid no later than 1 month after the decision has permanent legal force, Emil's property can be confiscated by the Prosecutor and auctioned off to cover the replacement money.
"In the event that the defendant does not have sufficient assets to pay the replacement money, he will be replaced with imprisonment for 6 years," said the presiding judge.
In imposing an appeal decision, the Panel of Judges considered several aggravating things, namely Emil's conscious act of ignoring state policies that were actively eradicating corruption and as a result of illegal mining in that case had an impact on huge state losses and severe environmental damage.
In addition to increasing Emil's verdict, the Jakarta High Court Panel of Judges also increased the sentence of PT Stanindo Inti Perkasa (SIP) benefits Suwito Gunawan alias Awi, Director of PT Sariwiguna Binasentosa (SBS) Robert Indarto, as well as tin ore collectors (collectors), Kwan Yung alias Buyung, who were also involved in the case.
In detail, Suwito's sentence was increased to 16 years in prison, a fine of Rp. 1 billion, subsidiary to 6 months in prison, and compensation of Rp. 2.2 trillion, subsidiary to 8 years in prison.
Then, Robert's sentence was increased to 18 years in prison, a fine of Rp. 1 billion, subsidiary to 6 months in prison, and compensation of Rp. 1.92 trillion, subsidiary to 10 years in prison.
Meanwhile, Buyung's sentence was increased to 10 years in prison and a fine of Rp. 750 million, subsidiary to 6 months in prison.
Previously in this case, Emil was sentenced by the panel of judges at the first instance to 8 years in prison and a fine of Rp. 750 million, subsidiary to 6 months in prison.
Suwito was sentenced to 8 years in prison, a fine of Rp. 1 billion, subsidiary to 6 months in prison, and compensation of Rp. 2.2 trillion, subsidiary to 6 years in prison.

The defendants were proven to be involved in the alleged corruption case in the management of tin commodity trading in the mining business permit (IUP) area of PT Timah Tbk. 2015 2022 caused a loss to state finances worth IDR 300 trillion.
The loss included as much as Rp2.28 trillion in the form of losses for the cooperation activities of renting processing equipment (processing) logging with private smelters, Rp26.65 trillion in the form of losses due to tin seed payments to mining partners of PT Timah, and Rp271.07 trillion in the form of environmental losses.
