Companies Asked To Comply With Jamsostek Program Obligations

JAKARTA - Hundreds of representatives of the BPJS Employment Branch Office Grogol attended the socialization of the development of the Employment Social Security (Jamsostek) program in Jakarta.

One of the important sessions in the socialization is the presentation of a number of rules regarding the rights and obligations of employers and workers to the Jamsostek program.

The material was conveyed by the Head of the West Jakarta Manpower, Transmigration and Energy Sub-Department (SudinACKertransgi) Jackson Dianrus Sitorus. Jackson conveyed three important points based on the regulation.

"First, employers are required to register all their workers without exception as participants in the Employment Social Security program," said Jackson.

Second, if companies employ foreign workers, they must also be registered as Jamsostek participants.

Third, the company is obliged to collect Jamsostek contributions from workers and deposit them to BPJS Ketenagakerjaan.

"I beg you not to let a company violate these rules. If it violates, it's tough," said Jackson.

Jackson reminded companies not to violate the first and second points.

Namely not registering all workers and not registering foreign workers to be participants in BPJS Ketenagakerjaan.

"Because this concerns workers' rights to get protection for the Employment Social Security program," Jackson said.

Jackson warned that there should not be cases of labor accidents that have not been registered as BPJS Ketenagakerjaan participants. Because if the case occurs it will have legal consequences.

"Workers or workers' heirs will demand their rights to the company, so that's finished," Jackson said.

This case could arise because of the company's actions of only registering some of its workers.

Likewise, if there are companies that register workers as BPJS Employment participants, only a portion of wages.

The problem will be discovered after the participants or heirs receive the rights which turn out to be inconsistent with the count.

"Like the benefits of the heirs of the work accident case, 48 times the salary, in the case of work accidents, the disabled participants receive 56 times the salary, but what they receive is not according to the salary multiplication. This company can be prosecuted," Jackson said.

Likewise, in point three, if there is a cut in workers' salaries but is not deposited as a BPJS Employment contribution, the perpetrators will be subject to criminal sanctions.

"I beg you very much not to let the company not comply with this provision. Because if something like this happens, like it or not, what we defend are workers," said Jackson.

According to Jackson, companies that do not comply with social security obligations are threatened with heavy losses.

He gave an example, in certain cases of violations, his party can impose sanctions for revocation of administrative service rights to PTSP (One Stop Integrated Service).

"The IMB office building has an extension time so it can't be done, if you want to change offices you can't take care of SIUP, nor can you participate in the auction because an auction permit is not issued," Jackson said.

Not to mention if the case is exposed by the media, the company's shares will drop.

For this reason, Jackson emphasized that all companies, especially under the guidance of the West Jakarta Nakertransgi Sub-Department, must comply with labor regulations.

Meanwhile, Head of the Jakarta Employment BPJS Branch Office, Grogol Multanti, appreciated the West Jakarta Nakertransgi Sub-dept. who reminded his fostered company to comply with social security regulations.

According to Multanti, this compliance is very important because it involves the right to protect the workers' Jamsostek program.

"We hope that this socialization material will become a guide for companies, especially our guidance to always avoid violating social security rules," said Multanti.
