Former Minister Of Social Juliari Peter Batubara Charged With Accepting Bribes Of Rp.32.4 Billion

JAKARTA - Former Minister of Social Affairs (Mensos) Juliari Peter Barubara is charged with accepting bribes worth Rp32.4 billion in the COVID-19 social assistance (bansos) project throughout Jabodetabek. The bribe was received through two of his men.

"As a person who commits or participates in several acts, which has a relationship in such a way that it must be seen as a continuing act, receiving a prize," said prosecutor M. Nur Azis reading out the dakwan at the trial at the Corruption Court, Jakarta, Wednesday, April 21.

Based on the indictment, Juliari accepted bribes through Adi Wahyono and Matheus Joko Santoso amounting to Rp1,280 billion from a private party named Harry Van Sidabukke. Then, Juliari also received money worth Rp1,950 billion from the President Director of PT Tigapilar Agro Utama Ardian Iskandar Maddanatja.

Finally, the indictment also stated that Juliari received money worth Rp.29,252,000,000 or Rp.29.2 billion from several goods providers in the social assistance project.

"Whereas it is known or should be suspected that the prize was given as a result or because he had done or did not do something in his position, which was contrary to his obligations," said the prosecutor

Thus, Juliari's actions are considered contrary to his obligations as state administrators not to commit acts of corruption, collusion and nepotism as stipulated in Article 5 number 4 and 6 of the Republic of Indonesia Law Number 28 of 1999 concerning State Administrators who are Clean and Free from Corruption, Collusion. and Nepotism and contrary to the provisions of Article 7 paragraph 1 letter h of Presidential Regulation Number 16 of 2018 concerning Government Procurement of Goods / Services.

In this case, Juliari and Adi will be charged with two articles of indictment. First, he allegedly violated Article 12 letter (b) in conjunction with Article 18 of the Corruption Law in conjunction with Article 55 paragraph (1) to 1 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code. Then, both of them were also suspected of violating Article 11 in conjunction with Article 18 of the Corruption Law in conjunction with Article 55 paragraph (1) to 1 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code.

Meanwhile Matheus, will be charged with Article 12 letter (b) Jo Article 18 of the Corruption Act in conjunction with Article 55 paragraph (1) to 1 of the Criminal Code Jo Article 64 paragraph (1) of the Criminal Code or Article 11 Jo Article 18 of the Anti-Corruption Law in conjunction with Article 55 paragraph (1) 1 of the KUHP in conjunction with Article 64 paragraph (1) of the Criminal Code. He is also suspected of violating Article 12 letter (i) of the Corruption Act in conjunction with Article 64 paragraph (1) of the Criminal Code.

Previously reported, the KPK named a number of suspects in connection with the alleged corruption case of social assistance (bansos) food packages for the handling of COVID-19 in the Greater Jakarta area, including former Social Minister Juliari Peter Batubara.

Apart from Juliari, the KPK also named four other suspects, namely the Commitment Making Officer (PPK) at the Ministry of Social Affairs Matheus Joko Santoso and Adi Wahyono as the bribe recipients and Andrian IM and Harry Sidabuke as the bribes.

This case began when Juliari appointed two commitment-making officials (PPK) Matheus Joko Santoso and Adi to carry out this project by directly appointing partners. The KPK suspects that it was agreed that there was a fee from the work package that partners had to pay to the Ministry of Social Affairs.

As for the fee for each COVID-19 social assistance package that Matheus and Adi agreed to, it was IDR 10,000 from a value of IDR 300 thousand.
