DPR Summons Minister Of Home Affairs Tito Karnavian To Discuss Resignation Of Regional Head Inauguration

JAKARTA - Member of Commission II DPR RI Mohammad Toha said today his party summoned the Minister of Home Affairs (Mendagri) Tito Karnavian to ask for an explanation regarding the postponement of the schedule for the inauguration of regional heads on February 18--20.

Toha said the plan to postpone the inauguration of regional heads on February 18-20, 2025 violated the rules, because it did not involve Commission II of the DPR RI in determining the inauguration schedule.

"The DPR RI (Commission II) was not involved in the schedule postponement. This violates the rules, that all related to electoral relations must involve the DPR and partners," Toha said in his statement, Monday, February 3.

He emphasized that the postponement of the schedule for the inauguration of regional heads was not in accordance with the decision of the meeting between Commission II and the government and election organizers. Therefore, the resignation is a unilateral decision of the Ministry of Home Affairs.

In a public hearing (RDPU) on February 22, 2025, Commission II of the Indonesian House of Representatives together with the Ministry of Home Affairs, KPU, Bawaslu, DKPP, concluded that the inauguration of 296 regional heads elected from the 2024 simultaneous regional elections, without any dispute, was held on February 6, 2025 in the State Capital by the President.

Indeed, continued Toha, the RDPU conclusion ignored the Constitutional Court Decision No.27/PUU-XXII/2024 which stated that the regional head inauguration was simultaneously carried out after the Constitutional Court resolved the dispute over the election results for cases that could not be accepted and rejected.

"Except for regions in disputes in the Constitutional Court, it was decided to re-election, or re-vote, or re-vote," he said.

Regarding the Constitutional Court's decision, before the RDPU was held, his party had asked the RDPU to comply with the Constitutional Court's Decision, even though the Constitutional Court's decision regarding elections or regional elections for the open legal policy category, or the DPR, could conduct a consolidational emergency, as long as it is not contrary to the 1945 Constitution.

The RDPU conclusion is also trying to annull Presidential Decree No. 80/2024 which ordered the inauguration of the governor and deputy governor as a result of the 2024 simultaneous regional elections to be held simultaneously on February 7, 2025.

Meanwhile, the inauguration of regents and deputy regents as well as mayors and deputy mayors will take place simultaneously on February 10, 2025.

The basic provisions of the Inauguration are contained in Law Number 10 of 2016 concerning Pilkada. a) Article 163 (1), "Governor and Deputy Governor are appointed by the President in the State Capital,' b) Article 164 (1) "Regents and Deputy Regents as well as Mayors and Deputy Mayors are appointed (at the same time) by the Governor in the respective provincial capitals," c) Article 164B, "The president as the holder of government power can appoint the Regent and Deputy Regent and Mayor and Deputy Mayor simultaneously.

Regarding Article 164 (1) and Article 164B, Toha can propose the Inauguration of Governors, Regents, Mayors and Deputys simultaneously by the President in the State Capital. For reasons, the efficiency of the state budget, as well as the effectiveness of central and regional performance.

However, when the RDPU decided that the inauguration of regional heads would be carried out in stages and starting on February 6 for regional heads who do not have disputes in the Constitutional Court, his party followed the decision.

However, the Ministry of Home Affairs suddenly planned to postpone the inauguration schedule for February 18-20 without discussing the changes with Commission II.

"It clearly violates the rules. For that, we call the Minister of Home Affairs to explain the plan to postpone the inauguration schedule," said the legislator from the Central Java V electoral district.

Toha added that reportedly the Constitutional Court plans to read out the dissal decision for 310 disputes over the results of the 2024 Simultaneous Regional Head Elections on February 4 and 5, 2025.

The former Deputy Regent of Sukoharjo for two periods said it was necessary to think about the beginning of the fate of the region based on the Constitutional Court's decision to conduct a re-voting or re-voting, including the two regions that will hold the re-cash due to losing to an empty box.

Toha suggested that the inauguration be simultaneously for the second phase. In addition, the consequences of the amendment to the Pilkada Law so that in the next 5-year period (Pilkada 2029) of the regions that take part in the simultaneous inauguration phase II will participate in the regional elections simultaneously with the simultaneous inauguration of stage I.

"This proposal is intended to stop disrupting the simultaneous National Pilkada which has been designed in 5 waves (2015, 2017, 2018, 2020, 2014)," he concluded.
