North Lombok Tsunami Shelter Corruption First Session, Public Prosecutor Says PKK Changes DED Projects Developed By BNPB
JAKARTA - The Corruption Court (Tipikor) at the Mataram District Court (PN), West Nusa Tenggara (NTB), held the inaugural trial of the corruption case in the tsunami shelter construction project in North Lombok Regency.
The two defendants Apriarily Nirmala and Agus Herijanto were present at the trial scheduled to read the indictment from the public prosecutor (JPU) of the Corruption Eradication Commission (KPK).
The KPK prosecutor, Greafik Loserte, in his indictment said that there was a criminal act of defendant Apriarily Nirmala as the official commitment maker (PPK) and Agus Herijanto as the project chief executive.
"That the defendant Aprially Nirmala as the PPK project has changed the DED (detail engineering design) project prepared by BNPB as the planner without going through technical ratification and verification," said the KPK prosecutor, Greafik Loserte at trial, quoted by Antara.
The prosecutor said that the defendant Agus Herijanto's criminal act as the project implementer carried out the work by referring to changes to the DED or design details that had been changed Apriarily Nirmala.
"Terdakwa dua, Agus Herijanto melaksanakan pekerjaan dari hasil perubahan rencana DED dan membuat laporan pertanggungan belanja yang tidak benar," tuturnya.
As a result of the change in the design, the findings of construction experts emerged regarding the decline in building material specifications that were not in accordance with the plan to build earthquake and tsunami-resistant buildings with the ability to withstand earthquakes on a scale of 9 richers (SR).
By outlining the criminal acts of the two defendants, the public prosecutor in the indictment charged Apriarily Nirmala and Agus Herijanto with committing and participating in criminal acts of corruption in project work in 2014 to state financial losses of Rp. 18.4 billion.
Therefore, the public prosecutor charged the two of them with violating Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
After hearing the reading of the indictment, the defendant Aprially Nirmala through his legal advisor filed a memorandum of objection or exception on the indictment of the public prosecutor.
Meanwhile, the defendant Agus Herijanto has not stated the same thing, but asked the panel of judges to study the indictment of the public prosecutor first.
After hearing the response, the panel of judges gave the two defendants the opportunity to submit an exception in the agenda for the follow-up trial which was set on Friday, January 31

The tsunami shelter construction project in North Lombok which was carried out in 2014 is the result of the collaboration between the Ministry of PUPR RI and the National Disaster Management Agency (BNPB) as a technical design.
The tsunami shelter in North Lombok Regency is one of 12 national scale development projects that took place in 2012 '2015 from the planning stage to the implementation of the work.
The project implementer is PT Waskita Karya, while the planning consultant from the building with a plan to accommodate the 3,000 people is PT Qorina Consultant Indonesia and supervisory consultant from CV Adi Cipta. The state allocates a budget for this work amounting to Rp23 billion.
Defendant Aprially Nirmala is a PPK for the tsunami shelter project from the NTB Province Building and Environmental Arrangement Work Unit (Satker PBL) at the Indonesian Ministry of Public Works and Public Housing (PUPR).
Agus Herijanto is the chief executive of the tsunami shelter construction project from PT Waskita Karya.
