Antam's Gold Corruption, Crazy Rich Surabaya Sued 16 Years In Prison

The defendant Budi Said as a businessman and securityrich Surabaya was sentenced to 16 years in prison in connection with the alleged corruption case of buying and selling gold precious metals of PT Antam Tbk. (Antam).

"The defendant Budi Said was therefore sentenced to 16 years in prison," said Public Prosecutor (JPU) Nurachman Adikusumo at the Corruption Court (Tipikor) hearing, Jakarta, as reported by ANTARA, Friday, December 13.

In addition to imprisonment, Budi Said was also charged with a fine of Rp. 1 billion, provided that if the fine was not paid, it would be replaced with imprisonment for six months.

The public prosecutor also demanded the panel of judges to impose additional penalties on Budi Said in the form of payment of replacement money to the state amounting to 58.13 kilograms of Antam gold or Rp35.07 billion and 1,136 kg of Antam gold or Rp1.07 trillion, based on the basic price of Antam's gold production as of December 2023.

"If the defendant is unable to pay the replacement money for one month after the decision has permanent legal force, then his property can be confiscated and auctioned off to cover the replacement money," said the prosecutor.

The prosecutor also demanded that the judge declare Budi Said to have been legally and convincingly proven guilty of committing a criminal act of corruption together, as the first primary cumulative indictment, as stipulated in Article 2 paragraph (1) in conjunction with Article 64 paragraph (1) of the Criminal Code.

In addition, Budi was also declared to have committed a crime of money laundering in the second cumulative primary indictment as regulated and threatened with crime in Article 3 of Law Number 8 of 2010 concerning Prevention and Eradication of Money Laundering (TPPU).

At the same trial, the Public Prosecutor also demanded that Antam's former General Manager (GM) Abdul Hadi Aviciena be sentenced to 7 years in prison and pay a fine of Rp. 500 million, a subsidiary of 3 months in prison.

In that case, Budi Said was charged with corruption by receiving a difference of more gold Antam of 58.13 kilograms or Rp35.07 billion, which was not in accordance with the gold sales invoice and there was no payment to Antam, causing a loss to state finances of Rp1.07 trillion.

In addition, there was an obligation to lose Antam's gold handover from Antam to the defendant Budi Said as much as 1,136 kilograms based on the decision of the Supreme Court Number 1666 K / Pdt / 2022 dated June 29, 2022.

Not only being charged with corruption, Budi Said is also suspected of committing money laundering (TPPU) from his corruption, among others, by disguising Antam's gold sales transactions to placing him as capital on CV Bahari Sentosa Alam.
