Former President Director Of PT Timah Sueded For 12 Years In Prison, Replacement Money Of Rp493 Billion

JAKARTA - President Director of PT Timah Tbk for the 2016-2021 period Mochtar Riza Pahlevi Tabrani was sentenced to 12 years in prison in connection with the alleged corruption case in the management of tin commodity trading in the mining permit (IUP) area of PT Timah in 2015 '2022.

The Public Prosecutor (JPU) of the Attorney General's Office, Ardito Muwardi, assessed that Mochtar had been legally and convincingly proven guilty of committing a criminal act of corruption together.

"Mochtar violated Article 2 Paragraph (1) in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with 55 Paragraph (1) of the 1st Criminal Code, as in the primary indictment of the public prosecutor," said the Public Prosecutor in a hearing reading the charges at the Jakarta Corruption Court reported by ANTARA, Thursday, December 5.

In addition to corporal punishment, the Public Prosecutor also charged Mochtar with a fine of Rp. 1 billion, provided that if the fine was not paid, it was replaced (subsider) with a one-year imprisonment.

Mochtar was also demanded to be sentenced to an additional penalty in the form of replacement money amounting to Rp493.39 billion by taking into account evidence of assets belonging to the defendant that had been confiscated.

If Mochtar is unable to pay the replacement money for one month after the decision has permanent legal force, said the prosecutor, then his property can be confiscated and auctioned off to cover the replacement money.

"In the event that the defendant does not have sufficient assets to pay the replacement money, he will be replaced with imprisonment for six years," said the prosecutor.

In the same trial, there was also the Finance Director of PT Timah for the 2016-2020 period Emil Ermindra who listened to the reading of the charges.

Emil was also charged with the same sentence as Mochtar, namely imprisonment for 12 years, a fine of Rp. 1 billion, and compensation of Rp.493.39 billion, with each of the same provisions and considered to have violated the same article.

Previously, Mochtar was charged with accommodating illegal tin mining activities in the mining permit (IUP) area of PT Timah which cost the state Rp300 trillion.

The illegal mining activities are carried out by five private smelters, namely PT Refined Bangka Tin (RBT), CV Venus Inti Perkasa, PT Sarijuna Binasentosa, PT Stanindo Inti Perkasa, and PT Tinindo Inter Nusa.
