Prosecutors Research The NTB Prosecutor's Office For Disability Files Without The Hand Of Suspects Of Sexual Harassment
The investigating prosecutor of the West Nusa Tenggara (NTB) High Prosecutor's Office (Kejati) conducted an examination of the file I Wayan Agus Suartama (IWAS), a disabled man without the hands of a suspect in a case of alleged sexual harassment.
Follow-up examination of the transfer of files that have been carried out by investigators from the West Nusa Tenggara (NTB) Regional Police (Polda).
"So, the case file on behalf of suspect I Wayan Agus Suartama (IWAS) alias Agus, which was handed over by police investigators to us, is currently still being investigated by the NTB Attorney General's Office, both in terms of formal and material completeness," said NTB Attorney General Efrien Saputera in Mataram, Wednesday, December 4, confiscated by Antara.
The case file, he explained, was transferred or in the first phase process from the police investigator to the investigating prosecutor on November 29, 2024.
If later the results of the prosecutor's research state that the files are complete or P-21, Efrien ensures that his party will officially notify the police investigators.
"On the other hand, there are still shortcomings in formal and material requirements, we will also issue P-19, return the files to investigators so that the underprivileged requirements can be completed immediately," he said.
Director of General Criminal Investigation (Dirreskrimum) Polda NTB Kombes Pol. Syarif Hidayat, previously said that his party was still waiting for the results of the examination of files by the prosecutor.
If the file has been declared complete, he ensures that the investigation will immediately follow up by transferring the suspect and evidence to the public prosecutor.
He assured that the IWAS case, which is now included in the examination of the file by the prosecutor, was a follow-up to the report of the victim who was a student.
In this case, Syarif said that there were two victims who had provided information and were complete files.
In addition, there is other evidence in the form of the results of the victim's post-mortem, witnesses from the victim's colleague and the suspect and the owner of an inn that became the location of the execution.
Evidence is also strengthened by information from psychologists from the Indonesian Psychology Association (HIMPSI).

In the file, investigators also describe the modus operandi of the IWAS suspect as a person with the disability of the disabled in committing immoral acts against the victim. This mode is done by relying on verbal communication that can affect the victim's psychology.
So that in the file, the investigator applies the suspicion of Article 6 letter c of Law Number 12 of 2022 concerning the Crime of Sexual Violence (TPKS).
While waiting for the results of the prosecutor's research, police investigators extended the detention period of the IWAS suspect in the status of house arrest within the next 40 days starting from Tuesday, December 3.
