Tom Lembong Remains In Bars, Judge Says Fulfill Detention Terms
JAKARTA - The sole judge of the South Jakarta District Court, Tumpanuli Marbun, said that the detention of former Trade Minister Thomas Trikasih Lembong alias Tom Lembong in the alleged corruption case of sugar imports had met the requirements.
"Administratively, the respondent has fulfilled it," said Judge Tumpanuli during a trial at the South Jakarta District Court, Tuesday, November 26.
For objective requirements, the Attorney General's Office (AGO) investigators are said to have complied with the rules contained in Article 21 paragraph 4 of the Criminal Procedure Code.
This is evidenced by several documentary evidence presented in the pretrial trial process, such as a detention warrant.
The letter has also been submitted by investigators to the suspect and his family.
"Considering that after also paying attention to the T72 evidence, namely a detention warrant that has been notified to the suspect or his family," he said.
"T73, namely the minutes of detention, the T75 evidence, namely a letter of extension of detention which has also been notified to the suspect or his family," continued Judge Tumpanuli.

In addition, Tom Lembong in this case was charged with Article 2 paragraph 1 in conjunction with Article 18 of Law Number 31 of 1999 concerning the eradication of criminal acts of corruption as amended by Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 junto Article 55 paragraph 1 of the Criminal Code.
Then, Article 3, Article 18 of Law number 31 of 1999 concerning the eradication of criminal acts of corruption as amended by law number 20 of 2001 concerning amendments to Uu number 31 of 1999 junto article 55 paragraph 1 of the Criminal Code.
The article states that the threat of imprisonment is more than five years. Thus, suspects who are suspected of having this article can be detained.
"So the reason for the detention of the applicant which is argued by the applicant as in the case of illegal Tang detention is that it is not based on law, therefore it must be declared rejected," said Judge Tumpanuli.
