KPK Leadership Rules Meet Cases Sued Alexander Marwata To MK

JAKARTA - KPK Deputy Chairman Alexander Marwata submitted a judicial review of Article 36 in Law Number 19 of 2019 concerning the KPK to the Constitutional Court (MK). This rule regulates a meeting between the leaders of the anti-corruption commission and litigants.

In the request for judicial review, Alexander mentioned his case at Polda Metro Jaya. He is known to be being investigated because he met the former Head of Yogyakarta Customs, Eko Darmanto, who was said to be a litigant because his gratification and money laundering cases were handled by the KPK.

The KPK leadership acted in his duties. The next meeting by the Metro Jaya Regional Police was carried out by the investigation process with the alleged criminal act as referred to in Article 36 letter a," reads Alexander's request for judicial review at the Constitutional Court, quoted Thursday, November 7.

This lawsuit was filed by Alex to the Constitutional Court through his attorney on Monday, November 4, 2024. Alexander assessed that there was an unclear limitation in the regulation.

"This shows that in real terms due to the Uncertainty of the Limit or the category of prohibition of relations for any reason in the article a quo has caused applicant 1 to be reported on suspicion of a criminal act," continued Alex's lawsuit.

Furthermore, Alexander feels the right to test the regulation because it refers to Article 28 D paragraph (1) and Padal 28 D paragraph (2) concerning the right to recognition, guarantee, and protection, as well as legal certainty. Article 36 of which he has sued is considered not in line with other regulations.

"Thus it is very clear that the Petitioners who currently serve as Deputy Chair of the KPK and other KPK employees are at a loss for their constitutional rights to obtain guarantees of legal certainty in carrying out their duties and responsibilities according to the Order of the Law," Alexander said in his lawsuit.

He said this lawsuit was important to file. This is because the KPK leadership must be free from anxiety in carrying out its duties.

"KPK leaders who are free from anxiety and anxious if one day due to compliance and obedience in carrying out their duties of responsibility interacting or dealing with the community can be punished," concluded Alexander.
