MAKI Submits Material Tests To The Constitutional Court Regarding The KPK's Capim Today

JAKARTA - Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman submitted a judicial review to the Constitutional Court (MK) today, Tuesday, November 5.

Boyamin questioned the leadership candidate (capim) and the KPK supervisory board which were handed over by President Joko Widodo (Jokowi) to the DPR RI before stepping down. According to him, the formation of the selection committee (pansel) to the submission of names should have been carried out by President Prabowo Subianto.

"As a personal person, today we will submit a judicial review application for the president's chaoticity who has the authority to form the KPK Pansel and at the same time submit it to the DPR," Boyamin said in a written statement to reporters, Tuesday, November 5.

"I believe that only President Prabowo has the authority to form a Pansel based on the Court's Decision Number 112 of 2023," he continued.

Boyamin said the submission of this judicial review is important for the eradication of corruption in the future. He did not want any suspects named by the KPK to take advantage of this gap.

Moreover, President Jokowi is said to be no longer authorized to submit the results of the Pansel to the DPR RI. "This JR is solely to save state programs related to eradicating corruption and saving the KPK from the lawsuit of the suspects under the pretext of illegal stipulation because the leadership is invalid due to illegal elections," said Boyamin.

As previously reported, a number of parties asked President Prabowo Subianto to re-shuffle the names of candidates for the leadership and supervisory board of the KPK. This is because President Joko Widodo (Jokowi) is considered not to have the right to submit it to the DPR.

Later, President Prabowo Subianto reportedly plans to issue a presidential letter (surpres) regarding the list of candidates for the leadership and supervisory board of the KPK. Minister of Law (Menhum) Supratman Andi Agtas said this step was taken following up on the letter sent by the DPR RI.

"As far as I know, the leadership of the DPR has sent a letter to the president. The President will also answer in the near future regarding the letter from the leadership of the DPR," Supratman said, Monday, November 4.

Supratman has not yet detailed the letter. However, he opened the opportunity for a change in the name of the candidate for leadership and supervisory board of the KPK.

Supratman explained that Prabowo had the right to reshuffle or maintain the name of the selection committee (pansel) which had been handed over by President Joko Widodo (Jokowi) before stepping down.

"It depends on the President (Prabowo Subianto, ed)," he said.

"Yes, both of them, he wants to score the same names, use the other committee for the president. Or want to form another, we depend on the president," continued Supratman.

Prabowo is also said that Supratman has the right to reshape the selection committee. Therefore, he asked all parties to wait further for the steps to be taken by the former Minister of Defense (Menhan) of the Republic of Indonesia.

"We'll just wait for the president's answer to the DPR. Definitely not too long, I think," said the Gerindra Party politician.
