Proven Corruption, Former Director Of RSUP H Adam Malik Medan Sentenced To 3 Years In Prison

JAKARTA - The panel of judges at the Corruption Court at the Medan District Court sentenced the former Managing Director of RSUP H Adam Malik, Bambang Prabowo (64), to three years in prison because it was proven corruption in the state financial management of the Public Service Agency (BLU) in 2018.

"The defendant Bambang Prabowo was sentenced to three years in prison," said Chief Judge Andriansyah, at the Corruption Court at the Medan District Court as reported by ANTARA, Monday, November 4.

In addition to imprisonment, the panel of judges also sentenced the defendant Bambang to pay a fine of Rp. 100 million, but if the fine was not paid, it would be replaced with two months imprisonment.

Although it is believed that corruption was proven, the panel of judges disagreed with the Public Prosecutor (JPU) of the Medan Kejari with an additional penalty, namely paying compensation for state financial losses.

The judge assessed that the defendant Bambang did not enjoy state financial losses of Rp. 8.05 billion as charged by the Public Prosecutor of the Medan Kejari, so he was not charged with paying replacement money.

"There is no evidence that the defendant is enjoying state financial losses," said Judge Andriyansyah.

In a separate file, the panel of judges also sentenced the other two defendants, namely the former Dirkeu Mangapul defendant RSUP H Adam Malik, to one year in prison and a fine of Rp. 100 million, subsidiary to one month in prison.

The judge also did not punish the defendant Mangapul for additional money for corruption, which cost the state finances Rp8.05 billion.

Meanwhile, the defendant Andriansyah Daulay, the former Treasurer of the BLU Expenditure at RSUP H Adam Malik, was sentenced to six years in prison and a fine of Rp. 100 million, subsidiary to one month in prison.

In addition to imprisonment and fines, the panel of judges also sentenced the defendant Andriansyah to pay compensation of Rp7.8 billion.

"With the provisions, if the replacement money is not paid within one month after the court's decision has permanent legal force or inkrah, the defendant's property will be confiscated and auctioned off by the prosecutor," he explained.

However, the panel of judges continued, if the defendant Andriansyah's property was not sufficient to cover the replacement money, it would be replaced with imprisonment of two years in prison.

The judge assessed that the three defendants fulfilled the elements of joint corruption in the financial management of BLU RSUP H Adam Malik, which cost the state finances Rp8.05 billion according to the calculation of the Indonesian Financial Audit Agency (BPK) Number: 06/LHP/XXI/02/2024 dated February 16, 2024.

"The three defendants violated Article 3 in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code, as stated in the subsidiary indictment," he asserted.
