Defendant In Case Of Alleged False Oath Conveys Apology At Trial

JAKARTA - The trial of the alleged false oath case with the defendant Ike Farida is back at the South Jakarta District Court (PN), Monday, October 28.

At today's trial, the defendant apologized to the Director of PT EPH, Ridwan, who was presented as a witness by the Public Prosecutor (JPU).

"I apologize to you as an older person than me. I never had any malicious intent against you," Ike Farida said in response to Ridwan's testimony.

Ike also admitted that she had never asked for Rp 50 billion in money related to this case.

"By Allah, I have never asked for Rp 50 billion. I am afraid that the people around you have bad intentions or don't like it if you are close to me, you can speak well. You are a good person, I am not a bad person. Here I have to defend myself," he said.

After that, the judge asked the witness about the possibility of resolving the case properly.

"Does the witness have any thoughts on resolving this issue in a good way?" asked the judge.

"Since the beginning, we have actually resolved this problem well, sir. But it is Mrs. Ike who has been attacking us constantly. Of the many consumers, only Mrs. Ike is like this. There are no other consumers like Mrs. Ike," replied Ridwan.

In addition, the Prosecutor also presented the former defendant's attorney, Nurindah MM Simbolon, to the trial.

Nurindah said the memory of judicial review (PK) by including three new pieces of evidence was the result of discussions and approval from the defendant before being submitted through the South Jakarta District Court.

"I only represented Mrs. Ike based on the power of attorney given to me. As for the novum oath, at first I didn't want to, but the defendant stated that I should represent it because there was already a power of attorney from the defendant," said Nurindah.

Nurindah admitted that it was impossible to do something without the defendant's consent, who at that time was his superior.

"So the PK memory complaint, every document sheet has been examined and initialized as a form of approval from the defendant," he said.

Meanwhile, the defendant's attorney, Kamaruddin Simanjuntak, said that no witness had given testimony that Ike had ever submitted a false oath.

"Three witnesses have been examined. No one has provided information that Ike Farida has provided false information," said Kamaruddin.

He also asked the Panel of Judges at the South Jakarta District Court who handled this case to release Ike Farida for judging that the prosecutor's indictment was not proven.

"He has to be free 100 percent. So today we ask the Panel of Judges to be free. Not a single word has been violated by Ike Farida. The mother must be free because all charges by the Public Prosecutor are not proven," he said.

In the previous trial which was held on Friday (25/10/2024), one of the witnesses presented was Ai Siti Fatimah, the legal part of PT, an apartment developer, which was bought by the defendant.

In his testimony, Ai said that there was no agreement to separate assets between the defendant and her husband, who is a foreign national (WNA).

Therefore, Ai said that the making of the Sale and Purchase Agreement (PPJB) and the Sale and Purchase Deed (AJB) between the developer and Ike could not be continued.

"If forced, the developer actually violates the law. In 2012 the developer offered Ike Farida the full refund, but was always rejected, so this problem lasted for up to 12 years," Ai said while testifying at the South Jakarta District Court.

Ai admitted that his party had offered the defendant to enter a new order so that in terms of law, the requirements for making PPJB and AJB were fulfilled.

"But the defendant still refused. This is what causes this case to drag on for up to 12 years and become a criminal case like today," he said.
