Denny Indrayana's Report On The General Election Supervisory Agency South Kalimantan About Political Complaints On Food For COVID-19

JAKARTA - The Honorary Board of Election Administrators (DKPP) has begun to hear the examination of alleged violations of the Election Organizer Code of Ethics (KEPP) which was complained by the Head of South Kalimantan, Denny Indrayana.

Candidate for governor of South Kalimantan Denny Indrayana complained to The General Election Supervisory Agency (Bawaslu) South Kalimantan through the attorney Muhamad Raziv Barokah. Denny Indrayana complained that Erna Kasypiah, Iwan Setiawan, Aries Mardiono, Azhar Ridhanie, and Nur Kholis Majid (Chairperson and Member of the South Kalimantan Bawaslu) as Defendants I to V.

Defendants, I to V are argued to have acted unprofessionally and had no legal certainty in following up on the report number 03/PL/PG/Prov/22.00/XI/2020 related to the alleged election violation committed by candidate pair number 1 on behalf of H. Sahbirin Noor as an incumbent. Alleged violations reported are related to the politicization of COVID-19 staples.

Complainant Denny Indrayana also argued that there was a fatal error in the study of report number 03/PL/PG/Prov/22.00/XI/2020 carried out by Defendants I to V. There was a discrepancy between the results of the analysis and the conclusions in the study. And the results of the study were not submitted to the Complainant.

The final argument for the complaint is that Defendant did not accommodate the Complainant's request to provide a report on the clarification of the Complainant's witnesses.

By the provisions of Article 31 paragraph (1) and (2) DKPP Regulation Number 1 of 2021 concerning Second Amendment to DKPP Regulation Number 3 of 2017 concerning Guidelines for Conducting the Code of Ethics for General Election Organizers, the trial will be chaired by DKPP Members and the Provincial Regional Inspection Team (TPD) South Borneo.

The Constitutional Court (MK) previously canceled the decision of the South Kalimantan KPU on the recapitulation of the victory of the candidate pair governor election of South Kalimantan Sahbirin Noor (Uncle Birin) and Muhidin. The Constitutional Court ordered a re-voting (PSU) in 7 sub-districts of South Kalimantan. The candidate for governor of South Kalimantan who contested Uncle Birin's victory, Denny Indrayana, was grateful for the MK decision.

The decision was read out by the Constitutional Court judge at the decision hearing regarding the dispute over the results of the general election (PHPU) for the Governor election South Kalimantan at the MK building, Friday, March 19. The lawsuit was filed by Denny Indrayana-Difriadi Darjat.

The seven sub-districts that were decided to hold a re-voting (PSU) are South Banjarmasin District in Banjarmasin City and five sub-districts in Banjar Regency and 24 polling stations (TPS) in Binuang District, Tapin Regency.
