Ternate District Court Sentenced Abdul Gani Kasuba To 8 Years In Prison In Bribery And Gratification Cases

TERNATE - The Panel of Judges at the Corruption Court at the Ternate District Court sentenced former North Maluku (Malut) Governor Abdul Gani Kasuba (AGK) to 8 years in prison in cases of bribery and gratification within the North Maluku Provincial Government.

"Determining the defendant Abdul Gani Kasuba to pay compensation in the amount of Rp. 109,056 billion and 90,000 US dollars with the condition that the Defendant Abdul Gani Kasuba does not pay replacement money no later than one month after the court's decision obtains face-to-face legal force," said the chairman of the Panel of Judges Kadar Nooh reading the verdict at the Ternate District Court, Antara, Thursday, September 26.

The trial of case decision number 11 / Pid.Sus-TPK / 2024 / PN Tte was chaired directly by the presiding judge Kadar Noh and with member judges Budi Setyawan, Khadijah A. Rumalean, Samhadi, and Yakob gave the AGK and JPU defendants the opportunity to act on the PN decision.

In the deliberation of the panel of judges stated that the defendant Abdul Gani Kasuba alias AGK had been legally and convincingly proven according to the law guilty of committing a criminal act of corruption as regulated by a criminal threat in Article 12 letter a jo. Article 18 of Law RI Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law of RI Number 20 of 2001 concerning Amendments to Law of RI Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption jo.

In addition, Article 55 paragraph (1) of the 1st Criminal Code jo. Article 65 paragraph (1) of the Criminal Code and the Second violates Article 12 letter b Jo. Article 18 of Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption Crime Jo.

Article 55 Paragraph (1) 1st of the Criminal Code Jo. Article 65 Paragraph (1) of the Criminal Code and the Third Violation of Article 12 B Jo. Article 18 of Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption Jo. Article 65 Paragraph (1) of the Criminal Code as in the first, second and third cumulative indictments.

The panel of judges in this case decided that the defendant Abdul Gani Kasuba was sentenced to 8 years in prison and a fine of Rp. 300 million with a subsidiary of 6 months in prison.

In addition, his property could be confiscated by the Prosecutor and auctioned off to cover the replacement money, in the event that the convict does not have sufficient assets to pay the replacement money, he will be sentenced to imprisonment for 3 years and 6 months.

"Determining the length of detention of the defendant is reduced entirely from the sentence imposed. Ordered the Defendant to remain in custody and stated that the evidence in the form of Number 1 to 891 or entirely used in other cases in the name of Imran Yakub, and to determine the court fee of Rp7,500 was charged to the defendant.

Previously, the KPK Public Prosecutor in his indictment requested that the Panel of Judges at the Corruption Court at the Ternate District Court who examined and tried this case decide against the defendant to be sentenced to 9 years in prison, 6 months in prison and a fine of Rp. 300, subsidiary to imprisonment for 6 months.

Meanwhile, the defendant AGK after listening to the Ternate District Court's verdict stated that he was thinking before making further legal efforts.

Likewise, the KPK prosecutor, Greafik stated that his party was also thinking about it and would take legal action for the next seven days in a case involving the former Governor of North Maluku for the two periods.
