Yudha Arfandi Is Being Sued For Death In The Case Of Dante's Death

JAKARTA - Dante's death trial was held again today, Monday, September 23 with the agenda of reading the demands by the Public Prosecutor (JPU) against Yudha Arfandi as the defendant in the alleged murder of Tamara Tyasmara's late son, Raden Andante Khalif Pramudityo.

In this trial, the Public Prosecutor finally charged Yudha Arfandi with the death penalty.

"We demand to declare the defendant Yudha Arfandi legally and convincingly guilty of committing a criminal act by deliberately taking the lives of others as in the first primary indictment of Article 340 of the Criminal Code," said the prosecutor at the East Jakarta District Court, Monday, September 23.

"The defendant yudha Arfandi was sentenced to death and stated that the defendant should be detained," he continued.

The prosecutor said that Yudha was found guilty in the alleged murder of Dante so that he was obliged to take responsibility for his actions.

"So we consider that the defendant's actions have been legally and convincingly proven in accordance with the elements of planning first, elementally, and elements of taking the lives of others," said the prosecutor.

In addition, the Prosecutor also considered mitigating and burdensome matters. The aggravating thing is that Yudha is considered negligent and makes the loss of someone's life, which is carried out in a sadistic manner, does not admit the act he has committed, until it is considered complicated in the trial.

"The situation relieves the defendant, there is no mitigating situation," said the prosecutor.

Atas tuntutan jaksa, hakim ketua memberikan waktu baik kepada Yudha dan tim kuasa hukumnya untuk menyiapkan memorandum daerah atau pledoi.

Yudha was charged with Article 338 of the Criminal Code and/or Article 340 of the Criminal Code and/or Article 76C in conjunction with Article 80 paragraph (3) of the Law on Child Protection. Article 338 of the Criminal Code regulates the act of deliberately taking the lives of others, with a maximum penalty of 15 years in prison.

Meanwhile, Article 340 of the Criminal Code regulates premeditated murder. The penalty is the death penalty or life imprisonment or a maximum of 20 years in prison.

Then Article 76C in conjunction with Article 80 paragraph (3) regulates the prohibition of committing violence against children. If the victim dies, the perpetrator can be sentenced to a maximum imprisonment of 15 years and/or a maximum fine of Rp. 3 billion.

Yudha admitted his mistake for drowning Dante in the swimming pool in the Duren Sawit area, East Jakarta. Yudha conveyed this in court on August 29 with the agenda of hearing the defendant's statement.
