The Prosecutor's Consideration Behind The 15th Anniversary Of Gazalba Saleh Prison

JAKARTA - The Public Prosecutor (JPU) has several considerations behind the decision to sue the inactive Supreme Court Justice, Gazalba Saleh, 15 years in prison in the case of alleged gratification and money laundering (TPPU). One of them has damaged public trust in the Supreme Court (MA).

"The defendant's actions undermine public trust in the Supreme Court of the Republic of Indonesia," said the prosecutor during a trial at the Jakarta Corruption Court, Thursday, September 5.

Another burdensome consideration is that Gazalba Saleh is considered not to support the government's program in eradicating corruption; it is complicated when giving information; and wants to benefit from criminal acts.

However, the prosecutor also had one mitigating consideration for Gazalba Saleh. The inactive Supreme Court judge was never convicted.

"The consideration is mitigating, the defendant has never been convicted," said the prosecutor.

In this case, Gazalba Saleh was not only charged with criminal sanctions. Rather, it is also a fine of Rp. 1 billion, subsidiary to 6 months in prison.

The claim was given based on several considerations, one of which was the fulfillment of elements of Article 12B of the Corruption Eradication Law.

Gazalba is considered proven to have received money from a number of parties for certain interests.

Then, Gazalba is also considered proven to have committed money laundering or money laundering as indicted by the two prosecutors, namely Article 3 of Law Number 8 of 2010 concerning Money Laundering.

In this case, Gazalba was charged with receiving gratuities related to the handling of cases at the Supreme Court (MA). In addition, he is also said to have committed a crime of money laundering (TPPU) with a total value of Rp62.89 billion.
