Tax Corruption Of IDR 500 Million, ASN Personnel In West Aceh Targeted By The Kejari

WEST ACEH - The West Aceh District Attorney has begun conducting an investigation into alleged regional tax corruption which is allegedly not deposited into the regional treasury, by ASN personnel with a value of more than IDR 500 million.

"The information we received from the public, this unpaid tax will occur at the end of 2022," said the Head of the West Aceh District Attorney, Siswanto, quoted by ANTARA, Sunday, August 18.

According to him, the tax, which was allegedly not deposited into the regional treasury, was allegedly used by an individual who was then tasked with receiving tax money in West Aceh Regency.

The tax of more than Rp. 500 million is estimated to come from a number of village heads and business actors in the regional tax sector, such as restaurant, restaurant and other taxes.

Siswanto explained that according to existing regulations, every tax levy that has been received by the authorities or treasurer, must be deposited into the regional treasury or into the state treasury no later than 1x24 hours after receiving it.

However, in reality, the money was allegedly used or used by ASN personnel who were tasked with receiving regional tax funds for personal gain.

"Tax money is state money, so if he doesn't deposit it, it means he has committed a criminal act of corruption," said Siswanto.

He said the examination of a number of these parties had also been scheduled by investigators from the West Aceh District Attorney on Tuesday, August 20, 2024.

"The parties we have summoned include the former treasurer, and other parties related to (regional tax receipts)," said Siswanto.

Regarding the efforts of the West Aceh Regency Government which is currently trying to confiscate the assets of individuals suspected of using the regional tax funds, Siswanto said this was questionable.

According to him, the local government is not authorized to confiscate assets or moving vehicles belonging to the public or ASN, because all the provisions for the confiscation of these assets contained applicable legal rules.

"What is the basis for the confiscation of the assets. If it is confiscated, then what do you want to do is goods, it is clear that the local government does not have the authority," said Siswanto.

Previously, the West Aceh Regency Government (Pemkab) through the Regional Financial Management Agency (BPKD) received guarantees from a former treasurer within the local government regarding the alleged tax evasion of Rp. 470.6 million which was allegedly not deposited into the regional treasury at the end of 2022.

"The guarantees that we have received are in the form of land certificates, motorized vehicles," said Head of BPKD West Aceh Regency Zulyadi in West Aceh, Thursday last week.

The tax allegedly not deposited into the regional treasury is thought to have come from the source of local tax revenues, which have been deposited by the tax object.

Zulyadi said the findings of not being deposited by regional taxes into regional treasury by the treasurer of the receipt had previously been reported to the BPK-RI Aceh Representative.

Currently, the local government continues to seek guarantees from former treasurers, so that later the guarantees that have been handed over to the West Aceh Regency Government will be immediately auctioned.
