Mexican Citizen Who Shot Turkish Citizen In Bali Demanded 4 Years In Prison

DENPASAR - The Public Prosecutor of the Badung District Attorney (Kejari), Bali, demanded 4 years in prison for four foreign national defendants (WNA) from Mexico, America in the shooting case of a Turkish citizen, Mehmet Turan.

The Public Prosecutor's Team of the Badung Prosecutor's Office, Imam Romdhoni and Agung Satria Putra, stated that the four defendants Jose Alfonso Aramburo Contreras (32), Mayorquin Escobedo Juan Antonio (24) Victor Eduardo Deraz Gonzalez (36) and Sisairos Valdes Roberto (27) were legally and convincingly proven guilty of committing violent theft.

This is as regulated and punishable by Article 365 paragraph (2) 1, 2 and 4 of the Criminal Code (KUHP) as the alternative indictments of the Two Public Prosecutors.

"Sentenced the defendants to imprisonment for 4 (four) years each," said Imam Romdhoni before the Panel of Judges I Putu Suyoga.

The prosecutor also asked the Panel of Judges to determine the length of the detention period that the defendants had served reduced entirely from the sentence imposed and stipulate that the defendants remain detained.

In the consideration of the prosecutor, the aggravating things for the defendants were the actions of the defendants disturbing the community, harming Mehmet Turan's witness, causing Mehmet Turan to experience trauma.

In addition, the defendants did not admit their actions and did not regret their actions against the victim Mehmet Turan.

The mitigating factors are that the defendants are the backbone of the family and the defendants have never been convicted.

The trial will resume on Tuesday (20/8) with a defense agenda.

In the trial revealed in the prosecutor's indictment, the attempted murder of Turkish foreigner Turan Mehmet was planned since December 2023 when the four Mexican foreigners arrived in Bali.

In the same month 2023, the four of them had gone to Jakarta to buy two Russian-made pistols with a caliber of 9 mm and a caliber of 7.65 mm from an unnamed person by the defendant.

In January 2024, at around 19.00 WITA when they returned to Bali, the defendants gathered at a restaurant in the Uluwatu area to plan an action.

To facilitate communication between perpetrators, they created a WhatsApp Group (WAG) called "MARINA" which in WAG was distributed information regarding the existence of Turkish citizen Turan Mehmet.

After the defendants found out the location of a Turkish citizen who was in the Villa Palm House, the defendant Victor Eduardo prepared two pistols and handed over one of the pistols to the defendant Jose Alfonso. To get to the location, the four Mexican foreigners used three motorbikes prepared by Jose Alfonso.

On Monday, January 22, 2024, at around 22.00 WITA, the defendants arrived at one of Indomaret who was close to the Villa Palm House location and then conducted a survey of the location along the entrance to Villa Palm House.

On Tuesday, January 23, 2024, at around 01.00 WITA, the defendants returned to Villa Palm House where the defendants I and II parked their vehicles in a dark place adjacent to Villa Palm House, while the defendant Juan Antonia Escobedo and the defendant Roberto Valdes immediately rode their motorbikes to Villa Palm House and stopped in front of the security post.

After confirming that the person being sought was at the villa, the defendants threatened security and pointed a gun and told him to lie down and confiscate his cellphone.

After that, the defendants entered the villa and broke the glass. Hearing the voice, Mehmet Turan's friend who was inside, namely Muhammet Enes Turan, Eren Kaya alias Daniel and David Abgariyan headed to the source of the sound. When they saw the perpetrator carrying a weapon, the four immediately fled outside the Villa.

When he saw the victim Mehmet Turan leaving the room, the defendant Viktor Eduardo immediately pointed a gun at him and gave him a gesture asking for money. The victim who wanted to fight was shot by the defendant Eduardo in the stomach.

Based on the testimony of witness Mehmet Turan when the witness fought against Defendant II by taking his gun, Defendant II fired his gun at the stomach which penetrated the waist of witness Mehmet Turan and when witness Mehmet Turan fled to the laundry room, Defendant II fired his gun and hit the arm of witness Mehmet Turan.

As a result of the two gunshot wounds, witness Mehmet Turan suffered bleeding wounds, especially in the stomach.

Based on the evidence of a letter in the form of a Visum Et Repertum on January 29, 2024, on the victim Mehmet Turan's body were found with open wounds surrounded by abrasions, as well as bruises based on the picture of the wound were the wounds of the shoot in and out.

"The number one and four injuries are incoming gunshot wounds, while other injuries are gunshot wounds out. Conditions in these patients have caused illness or obstacles in carrying out job or livelihoods for a while," said the prosecutor.

Because there was information from the security forces on their way to the location, the defendants rushed away with cash of Rp. 40 million and US$4,000, as well as the victim's watch which was stored in the bag.

In the evidence, according to the prosecutor, the elements of the act resulting in serious injuries have been obtained with valid evidence and have fulfilled the minimum principle of proof as stipulated in Article 183 of the Criminal Procedure Code.

Thus, the elements of his actions resulting in serious injuries have been legally and convincingly proven.
