Not The Minister Of Energy And Mineral Resources, The Authority To Grant An Ormas Mining Permit Is In Bahlil's Hands
JAKARTA - President Joko Widodo signed Presidential Regulation (Perpres) Number 76 of 2024 concerning Amendments to Presidential Regulation Number 70 of 2023 concerning Land Allocation for Investment Arrangement on July 22, 2024.
In the new regulation, President Jokowi transferred the authority to determine the Special Mining Business Permit Area (WIUPK) for religious community organizations (ormas) from the Minister of Energy and Mineral Resources to the Minister of Investment/Head of BKPM, which is currently held by Bahlil Lahadalia.
"The Minister of Trustees of the Sector delegates the authority to determine, offer, and give WIUPK as referred to in Article 5A paragraph (1) to the minister/head of the agency that organizes government affairs in the field of investment/coordination of investment as the head of the Task Force," reads Article 5B paragraph (1) Presidential Regulation 76 of 2024, quoted Wednesday, July 24.
Later, the head of the task force will determine, offer, and give WIUPK to Business Entities owned by religious organizations as stated in Article 5B paragraph 2.
Then in Article 3 it is stated that the provision of WIUPK, business entities belonging to religious organizations must apply for IUPK through the OSS system.
Previously, the government issued PP number 25 of 2024 regarding amendments to Government Regulation (PP) Number 96 of 2021 concerning the Implementation of Mineral and Coal Mining Business Activities which were signed on May 30.
The rules related to the management of WIUPK by mass organizations are listed in Article 83A which states, (1) in order to improve community welfare, WIUPK can be made a priority offer to Business Entities owned by religious community organizations.

In this regulation, religious organizations can obtain IUPK from the former Coal Mining Concession Work Agreement (PKP2B).
Just so you know, the government has prepared 6 lands for the former Coal Mining Concession Work Agreement (PKP2B) to be managed by religious community organizations (ormas) as stated in PP number 25 of 2024.
The mining land consists of former PKP2B PT Kaltim Prima Coal (KPC), PT Arutmin Indonesia, PT Kendilo Coal Indonesia, PT Adaro Energy Tbk, PT Multi Harapan Utama (MAU), and PT Kideco Jaya Agung.
