Handling Technical Evaluation Of Issuance Of IUP For Mass Organizations, The Ministry Of Energy And Mineral Resources Reveals A Number Of Mandatory Criteria
JAKARTA - The Ministry of Energy and Mineral Resources (ESDM) is predicted to be the EVilator for technical matters related to the issuance of Special Mining Business Permits (IUPK) for religious community organizations (ormas).
After conducting an evaluation, the mass organization permit file will then be transferred to the Ministry of Investment/BKPM to then issue an IUP.
"We are the ones who provide the permit. Indeed (the authority to give permission) has been delegated to the BKPM, delegated to the approval for one door. The technical evaluation remains at ESDM," said Head of the Communications, Public Information Service, and Cooperation (KLIK) of the Ministry of Energy and Mineral Resources Agus Cahyono Adi to the media quoted Wednesday, June 5.
Agus said, to obtain a letter of recommendation, there are criteria that must be met by business entities of religious organizations such as financial capabilities, technical capabilities, and management capabilities.
"If you can't meet the requirements, then you can't," continued Agus.
Furthermore, Agus explained, WIUPK or the Special Mining Business License Area which will be offered to religious mass organizations will also be strictly regulated by the Ministry of Energy and Mineral Resources.
Then regarding public concerns about the emergence of other horizontal conflicts with other mass organizations, Agus said the government would also issue derivative regulations in the form of presidential regulations that would explain in detail about these regulations.
The Presidential Decree will also regulate further provisions regarding the priority offer of WIUPK to business entities belonging to religious community organizations.
"Later, the presidential regulation will be issued, there are procedures (of the offer)," said Agus.
For information, previously President Joko Widodo officially signed a Government Regulation that allows religious community organizations (ormas) to manage the Special Mining Business Permit Area (WIUPK).
This provision is stated in PP number 25 of 2024 regarding amendments to Government Regulation (PP) Number 96 of 2021 concerning the Implementation of Mineral and Coal Mining Business Activities which were signed on May 30.

The rules related to the management of WIUPK by mass organizations are listed in Article 83A which states, (1) in order to improve community welfare, WIUPK can be made a priority offer to Business Entities owned by religious community organizations.
The WIUPK as referred to in paragraph (1) is an area of the former Coal Mining Concession Work Agreement (PKP2B).
