Four Defendants Of The Mimika Kingmi Church Corruption Case Sentenced To 1-4 Years In Prison

The four defendants in the corruption case of the construction of the Kingmi Mile 32 Church in Mimika, Papua, were sentenced to 1 year to 4 years in prison in the trial of reading the verdict of the Panel of Judges at the Jakarta Corruption Court (Tipikor).

Chairman of the Panel of Judges Deny Riswanto said the four defendants were former Head of the Road and Bridge Maintenance Section of the 2015-2020 Mimika District Public Works Office Totok Suharto, Head of PT Satria Kresindo Prima Gustaf Urbanus Pantadinan Branch, Director of PT Waringin Megah Arif Yahya, and Site Engineer PT Geo Inti Spatial Budiyanto Wijaya.

"The four defendants were legally and convincingly proven guilty of committing a criminal act together as indicted by the public prosecutor (JPU)," Deny said as quoted by ANTARA, Friday, May 31.

The four defendants were proven to have violated Article 3 in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code (KUHP) as indicted by the two public prosecutors.

Deny revealed that Totok was sentenced to 1 year and 8 months in prison and a fine of Rp. 50 million, subsidiary to 1 month in prison. The verdict is lower than the demands of the Corruption Eradication Commission (KPK) prosecutor who demanded imprisonment for 2 years and 3 months and a fine of Rp. 100 million, subsidiary to 4 months in prison.

Then for Gustaf, the panel of judges sentenced him to 3 years in prison and a fine of Rp. 100 million, subsidiary to 2 months in prison, and to pay compensation of Rp. 379.01 million, subsidiary to 1 year in prison.

The verdict for Gustaf is also lower than the prosecutor's demands in the form of a 4-year prison sentence and a fine of Rp. 100 million, subsidiary to 3 months in prison. However, the nominal payment of replacement money handed down by the Panel of Judges to Gustaf remains the same as the demands.

To Arif, Deny stated that the Panel of Judges sentenced him to 4 years in prison and a fine of Rp. 300 million, subsidiary to 6 months in prison, as well as payment of compensation of Rp. 2.82 billion, subsidiary to 3 years in prison.

The verdict handed down to Arif was lighter than the previous demand in the form of imprisonment for 4 years and 11 months, a fine of Rp. 300 million, subsidiary to 6 months in prison, and payment of replacement money to the state amounting to Rp. 3.41 billion, subsidiary to 3 years in prison.

Furthermore, for Budiyanto, the judge sentenced him to 4 years in prison and a fine of Rp. 300 million, subsidiary to 6 months in prison, and paid compensation of Rp. 2.47 billion, subsidiary to 3 years in prison.

Budiyanto's sentence was imposed lower than the prosecutor's demand, namely imprisonment of 4 years and 9 months and paying compensation of Rp3.04 billion, subsidiary of 3 years in prison. But for the fine, the sentence given is the same as the demand.

Gustaf, Arif, Budiyanto, and the KPK prosecutors expressed their thoughts on the decision of the Panel of Judges. Meanwhile, Totok stated that he accepted the verdict handed down to him.

Previously, the four defendants were charged with causing state financial losses of Rp. 14.2 billion related to the construction of the Kingmi Mile 32 Church in Mimika Regency, Papua.

This action was carried out together with the Mimika Regent for the 2014-2019 period Eltinus Omaleng and the Commitment Making Officer (PPK) in the People's Welfare Section of the Regional Secretariat (Setda) of Mimika Regency for the 2015 Fiscal Year, Marthen Sawy.

Arif and Budiyanto are Eltinus confidants in finding several contractors who do not have the qualifications to work on the Kingmi Mile 32 Church construction project and receive some money for their services.

Then Gustaf acted as a consultant planner and supervisory consultant, but did not supervise the implementation of the work which resulted in the progress of the work being slow so that the work volume and quality of the work did not match the contract.

Meanwhile, Totokm, chairman of the auction committee for planning consultant services, played a role in conditioning various auction documents, thus winning certain companies as requested by Eltinus.
