Four Defendants In The Mimika Papua Kingmi Church Corruption Case Sued 2-4 Years In Prison
JAKARTA - The Public Prosecutor of the Corruption Eradication Commission (KPK) has charged four defendants in the corruption case of the construction of the Kingmi Mile 32 Church in Mimika, Papua, with imprisonment for more than two years and four years.
The KPK Public Prosecutor said the four defendants, namely the former Head of Road and Bridge Maintenance Section of the 2015-2020 Mimika District Public Works Office, Totok Suharto, Director of PT Waringin Megah Arif Yahya, Branch Head of PT Satria Cresindo Prima Gustaf Urbanus Pantadinan, and Site EngineerPT Geo Inti Spatial Budiyanto Wijaya.
"We demand that the Panel of Judges declare that the defendants have been legally and convincingly proven guilty of committing a criminal act of corruption together," said the KPK prosecutor during a trial reading the charges at the Jakarta Corruption Court (Tipikor), reported by ANTARA, Wednesday, May 15.
The prosecutor revealed that the defendant Totok was sentenced to imprisonment for two years and three months, Arif for four years and 11 months, Gustaf for four years, and Budiyanto for four years and nine months.
In addition to imprisonment, he said, the four defendants were also charged with a fine of Rp. 100 million, subsidiary to four months in prison for Totok, Rp. 300 million, subsidiary to six months in prison for Arif, Rp. 100 million, subsidiary to three months in prison for Gustaf, and Rp. 300 million, subsidiary to six months in prison for Budiyanto.
Especially for Arif, Gustaf, and Budiyanto, the KPK prosecutor demanded additional punishment. In detail, the additional sentence that was charged to Arif in the form of payment of replacement money to the state amounted to Rp3.41 billion, subsidiary to three years in prison.
Then the additional sentence demanded by the KPK prosecutor to Gustaf, namely to pay compensation of Rp379.01 million, subsidiary to imprisonment for one year, while Budiyanto was charged with additional punishment in the form of payment of replacement money to the state amounting to Rp3.04 billion, subsidiary to three years in prison.
Previously, the four defendants were charged with causing state financial losses of Rp. 14.2 billion related to the construction of the Kingmi Mile 32 Church in Mimika Regency, Papua.
This action was carried out together with the Mimika Regent for the 2014-2019 period Eltinus Omaleng and the Commitment Making Officer (PPK) in the People's Welfare Section of the Regional Secretariat (Setda) of Mimika Regency for the 2015 Fiscal Year, Marthen Sawy.

Arif and Budiyanto are Eltinus confidants in finding several contractors who do not have the qualifications to work on the Kingmi Mile 32 Church construction project and receive some money for their services.
Then Gustaf acted as a consultant planner and supervisory consultant, but did not supervise the implementation of the work which resulted in the progress of the work being slow so that the work volume and quality of the work did not match the contract.
Meanwhile, Totok is the chairman of the auction committee for planning consultant services who played a role in discriminating various auction documents, thus winning certain companies as requested by Eltinus.
For their actions, the four defendants were charged with violating Article 2 Paragraph (1) or Article 3 of Law Number 31 of 1999 concerning the eradication of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code (KUHP).
