Denies There Is A PPP Voice Moving To The Garuda Party, KPU Asks For Evidence Of Locus Delicti

JAKARTA - The KPU denied the transfer and reduction of votes belonging to PPP to the Garuda Party to fill the candidates for members of the DPR RI North Sumatra Province (North Sumatra District) for the electoral districts 1, 2, and 3.

The rebuttal was conveyed by the KPU's attorney, Yuni Iswantoro, in the third panel session for the 2024 Election Result Dispute (PHPU) case at the Constitutional Court Building, Jakarta, Monday, May 13. Valid as the Petitioner is PPP and valid as the Respondent is the KPU.

"The Petitioner argued that there was a transfer of votes from the Petitioner party to the Garuda Party as well as a reduction in the votes acquired by the Petitioner in the North Sumatra electoral district 1, 2, and 3. According to the Respondent, the transfer and reduction of votes were untrue and groundless according to the law," said Yuni.

He emphasized that the PPP argument which stated that the party's transfer of votes to the Garuda Party was 4,987 votes in the North Sumatra electoral district 1, 5,420 votes in the North Sumatra 2 electoral district, and 6,000 votes in the 3rd North Sumatra electoral district were untrue and baseless.

He also said that PPP was not clear and complete in conveying at the stage whether the process of transferring PPP votes to the Garuda Party was carried out.

"Moreover, in the locus where the alleged vote shift to the Garuda Party was carried out. TPS, sub-districts, districts, provinces, or nationally? The applicant did not explain at all," he said.

The PPP mandate witness, he continued, has also put a signature on the process of determining the recapitulation of the results of the vote count at the district level for the three electoral districts.

"That up to the process of determining the results of votes at the provincial level, there is also no transfer and reduction of votes from the Respondent to the Garuda Party," he said.

Based on this description, the KPU asked the Constitutional Court to reject the Petitioner's application in its entirety and stated that it was true and the KPU's Decree No. 360 of 2024 concerning the determination of the results of members of the DPR RI.

On Monday, the Constitutional Court held a hearing with the agenda of hearing the Respondent's answer, the relevant party's statement, and Bawaslu's statement and the ratification of evidence from the parties.

The first panel session was chaired by Constitutional Justices Chief Justice of the Constitutional Court Suhartoyo and accompanied by Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
