Session Of The 2024 Legislative Election Dispute, Saldi Isra Tegur, A DPD Candidate For The NTB Electoral District Who Did Not Submit Information

JAKARTA - Constitutional Justice Saldi Isra reprimanded one of the attorneys of the Related Party who did not submit the information file to the Registrar of the Constitutional Court (MK).

The incident occurred during a follow-up hearing on panel two for the PHPU case for the 2024 Legislative Election at the Constitutional Court (MK) Building, Jakarta, Tuesday, May 7. This trial is related to case Number 02-19/PHPU.DPD-XXII/2024 proposed by individual applicants, namely a candidate for DPD member of the NTT electoral district named Elyas Yohanis Asamau.

Valid as the Respondent is the KPU and applies as a Related Party is a candidate for legislative member of the DPD Electoral District of NTT Hilda Manafe.

At first, Saldi said that the Attorney for Hilda Manafe did not submit information as a related party.

Then, the lawyer for Hilda Manafe, Dominggus Manuel Umbu Rampaka Lende, explained that his party wanted to file a file, but was still waiting for one piece of evidence, namely the D Result form, which was also not given by his client as the principal until the day of the trial.

"So I confirmed to the Court to give it today and from the administrative department of the Court said it could be submitted this morning," he said.

"You're a lawyer, you have to be able to distinguish information from evidence. What you have to convey one day before the trial is information. You can convey the evidence earlier (at trial)," said Saldi.

Then, Saldi again confirmed that the relevant party's attorney had not submitted the information file.

"You were told one day before, but yesterday you didn't hand it over, did you?" asked Saldi.

"Yes, but I confirmed it to the Court yesterday," answered Dominggus.

"No, my question is, do you submit (the information) or not?" asked Saldi again. "No," answered Dominggus.

Furthermore, Saldi asked Dominggus to read out the points of the information submitted. However, Dominggus read out the parts that had been received by the Panel of Judges, so that the judge's explanation was cut.

"Earlier I said, we have said it is considered possible. There are two entrances, there are doors here and here. We consider it justified," said Saldi.

Hearing Saldi's answer, Dominggus defended his argument.

"Allow, Your Honor, but based on Article 7 of the Constitutional Court Regulation (PMK)..." he said.

"Don't argue with me," said Saldi.

At the end of giving information from the Related Party, Saldi again confirmed that the person concerned did not submit the statement one day before the trial and was later confirmed by Dominggus.

On Tuesday, the Constitutional Court held a hearing with the agenda of hearing the Respondent's answer, the relevant party's statement, and Bawaslu's statement and the ratification of evidence from the parties.

The trial of panel two was chaired by Constitutional Justices Saldi Isra accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani.
