Bali Prosecutor's Office For The Reconstruction Of OTT Bendesa Adat Peras Investors Rp10 Billion

The Bali High Prosecutor's Special Crime Investigators carried out a reconstruction or reconstruction of the hand arrest operation (OTT) against the Adat Berada Bendesa Ketut Riana on suspicion of extortion of an investor worth Rp. 10 billion.

Based on observations at Cafe Casa Bunga, Renon, Denpasar, Ketut Riana, who has been named a suspect along with the Special Crime Investigators of the Bali Attorney General's Office, arrived at 10.40 WITA.

Ketut Riana came wearing an orange vest and her hands were handcuffed, flanked by prosecutors. Shortly before starting the reconstruction process, the family came to Ketut Riana to provide support.

One of the legal advisers from Ketut Riana was also presented in the reconstruction, namely Gede Pasek Suardika to witness the series of arrests of KR. In addition, witness AN, who was secured together with KR the day before, also followed the reconstruction process.

The reconstruction activity ran for 30 minutes starting at 11.00 WITA to 12.00 WITA.

Head of the Legal Information Section of the Bali Prosecutor's Office, Agus Eka Sabana Putra, said Ketut Riana underwent a reconstruction of nine scenes and was carried out smoothly starting from the suspect KR getting out of the car, entering the Casa Bunga Cafe, talking with witness AN, the transaction of handing over Rp100 million in cash, the arrest by the Bali Attorney General's Office, and being escorted to the Bali Attorney General's Office.

Eka explained that the reconstruction was carried out to provide an overview or certainty to investigators from the testimony of witnesses so that it was concurrently a criminal act ranging from arrivals, talks to shifting money from those who brought to those who asked.

"The point is that today's reconstruction is to give confidence to investigators from the statements of witnesses who each gave statements, so that some witnesses who gave statements did not stand alone, but put together a criminal incident, it was sought by investigators," he said, quoted by ANTARA, Friday, May 3.

Eka explained that Ketut Riana was named a suspect because he had fulfilled the elements of Article 1 paragraph 2 letter C of the Corruption Crime Law (UU Tipikor) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and added by Law no. 20 of 2021 concerning amendments to Law no. 31 of 1999 concerning Criminal Acts of Corruption.

Ketut Riana merupakan Bendesa Adat Berawa, Kecamatan Kuta Utara, Kabupaten Badung yang mendapatkan uang dari dana APBD Provinsi Bali, sehingga kejaksaan memiliki kewenangan untuk menangani perkara tersebut.

Meanwhile, responding to the determination of the suspect Bendesa Adat Berawa Ketut Riana, as legal advisor Gede Pasek Suardika, he said that the determination of the suspect against RK, which incidentally was not a public position, was a new legal phenomenon in Bali.

"This is a new legal phenomenon for Bali. Is this customary village position a special crime or general crime? If it is a general crime, it is not the prosecutor's office that handles it for investigation, but if he is a special crime, it is the prosecutor's domain," he said.

However, he is still limited to providing legal assistance to KR while waiting for further processing from investigators.

He believes that the legal process involving KR will be handled professionally by the Bali High Prosecutor's Office.

"I am sure the process will be professional, measurable and presented in court better. Later we will see the details, what evidence we don't know because this is OTT, different from other cases," he said.
