Wants To Give A Maximum Deterrent Effect From Sentences Of 14 Years In Prison, KPK Files Cassation For Rafael Alun's Case
JAKARTA - The Corruption Eradication Commission (KPK) has filed an appeal against the decision of the former Directorate General of Taxes at the Ministry of Finance (Kemenkeu) Rafael Alun Trisambodo. This step was taken in response to the decision at the appeal level.
"KPK Prosecutor Arjuna BS Tambunan has officially declared an appeal through Panmud Corruption at the Central Jakarta District Court," said Head of the KPK News Section Ali Fikri to reporters quoted on Thursday, March 28.
Ali said this cassation submission was in accordance with his institution's commitment to confiscate Rafael's assets which were suspected of being the result of corruption. One of them is the house in Simprug Golf XV Number 29, Kebayoran Baru, Jakarta Selaan.
In addition, the anti-corruption commission also assessed that there was inconsistency in the decision of the panel of judges at the appeal level.
"The prosecutor remains confident that some of the assets in the previous decision that were decided to be returned were the result of corruption committed by the defendant," he said.
Ali hopes that the panel of judges at the cassation level understands and agrees to provide a maximum deterrent effect for perpetrators of corruption such as Rafael Alun. This is because corruption destroys people's lives.
"The lack of juridical arguments from the Prosecutor's Team will be stated in the memorandum of cassation," said Ali.
"KPK hopes that the panel of judges at the cassation level agrees that corruption damages the lives of many people and later in the decision consider and prioritize asset recovery as a form of deterrent effect," he continued.

Rafael Alun was previously sentenced to 14 years in prison and a fine of Rp. 500 million, subsidiary to three months in prison by the DKI Jakarta High Court. He was also required to pay compensation of Rp. 10,079,095,519, subsidiary to three years in prison as an additional penalty.
Even so, the judge asked for a house on Jalan Simprug Golf XIII Number 29, RT 02 RW 08, Grogol Selatan, Kebayoran Lama, South Jakarta, on behalf of Ernie Meike or Rafael's wife to be returned. While the rest, such as houses, land, and one unit of VW Carravelle cars were confiscated for the state.
