MK: Anwar Usman Does Not Participate In Handling Disputes On The Results Of The Presidential Election And PSI Special Legislative Elections
Constitutional judge Anwar Usman cannot participate in handling disputes over general election results (PHPU) or disputes over the results of the 2024 presidential election and disputes over the results of the 2024 legislative elections, especially for the Indonesian Solidarity Party (PSI).
Anwar Usman can still be involved in handling cases of the 2024 Legislative Election dispute except for disputes related to PSI.
"Your Excellency Mr. Anwar can still (handle the legislative dispute) according to the Constitutional Court's decision as long as it has no interest. For the presidential election, he did not participate, if the legislative election continues, except for the PSI case," said the spokesman for the Constitutional Court (MK) judge Enny Nurbaningsih, Monday, March 25.
It is known that the legislative PHPU case is handled by 3 panel of Constitutional Court judges in which each panel consists of 3 judges. Each panel is led by the Chief Justice of the Constitutional Court Suhartoyo, Deputy Chief Justice of the Constitutional Court Saldi Isra and the judge of the Constitutional Court Arief Hidayat.
Other Constitutional Court judges can enter the 3 panels on condition that Judge Arsul Sani does not participate in the dispute over the results of the PPP legislative election and judge Anwar Usman does not participate in handling the dispute over the results of the PSI legislative election.
This is to prevent conflicts or conflicts of interest because Arsul Sani is a former PPP politician. Then, Anwar Usman has a family relationship with PSI Chairman Kaesang Pangarep, who is his nephew.
It is known that the Constitutional Court's decision registered with Number 2/MKMK/L/11/2023, has prohibited Anwar Usman from being involved or involved in examination and decision making in disputes over the results of the presidential and vice presidential elections, election of members of the DPR, DPD, and DPRD, as well as the election for governors of regents and mayors who have the potential for a conflict of interest.

This prohibition is because Anwar Usman was proven to have committed a serious ethical violation. In addition, Anwar Usman was also sanctioned for being dismissed from the position of Chief Justice of the Constitutional Court.
Anwar Usman has no right to run or be nominated as the leader of the Constitutional Court until his term as a constitutional judge ends.
