Polda Metro Jaya Holds Case Regarding Alleged False Pledge With Suspect Ike Farida
JAKARTA - The Metro Jaya Regional Police conducted a special case related to the information or oath of fraud with the suspect Ida Farida. The determination of the suspect is related to allegations of making false oaths reported by the developer in 2021.
The conflict in the sale and purchase of apartments in the Tebet area, South Jakarta between advocate Ike Farida and property developers is still ongoing.
The two sides sued each other until Ike Farida was named a suspect in the alleged case of committing a false oath by the Polda Metro Jaya investigators.
"The title of this case being questioned is various parties, including from the title participants," said the developer's attorney, Wijayono Hadi Sukrisno, Sunday, February 23.
"From us, we have also asked for information, from the reported party, several witnesses have also been questioned by the leadership of the title, yes," he continued.
Wijayono said that all evidence had been submitted by his party so that the case became clear.
"We only have one request from us, so this case has been protracted since 2021, all parties have been examined, all evidence has been done, expert statements have also been made, and there has also been a determination of the suspect," he said.
"And we ask that this case be processed immediately according to legal provisions to be transferred to the prosecutor's office, later tried in court, later it will be found out who is right, who is wrong," he continued.
As is known, Ike Farida is the owner of the apartment unit.
The dispute began in 2012. At that time Ike, who was married to foreigners, bought an apartment unit for approximately Rp. 3 billion.
After the unit was paid in full, the developer refused to hand over the unit because Ike Farida married a foreigner and did not have a marriage agreement.
Ike Farida then conducted a judicial review to the Constitutional Court and asked for articles regarding the marriage agreement to conduct a judicial review.
The Constitutional Court granted Ike's request and assessed that Article 29 paragraph 1 of Law Number 1 of 1974 concerning Marriage is contrary to the 1945 Constitution.
The Constitutional Court decided that the phrase 'at the time or before the marriage was held' in Article 29 paragraph (1) and the phrase 'during the marriage' in Article 29 paragraph (4) of Law 1/1974 was conditionally contrary to the 1945 Constitution as long as it was not interpreted, including during the marriage bond.
Ike Farida then brought the case to court and won at the reconsideration level (PK).
The PK Council decided that the developer had defaulted and stated that Ike was a buyer with good faith and should be protected by law.
The Supreme Court also sentenced the plaintiff to process PPJB and AJB apartments.
The developer then felt disapproved of the results of the PK because of the alleged false oath made by Ike Farida.
Therefore, the developer made a police report (LP) at Polda Metro Jaya.
After that the police named Ike Farida as a suspect and entered the wanted list (DPO).
The report has also been registered with the number LP/B/4738/IX/2021/SPKT/POLDA METRO JAYA, DATED SEPTEMBER 24, 2021.
Now, the apartment unit, said the developer, has been handed over to Ike Farida.

Meanwhile, Ike Farida insists that she has never made a false oath.
"So actually it seems that I don't want to or avoid handing over the unit to me because I am married to a foreigner or because the person concerned does not have a permit, that's a question, it was explained earlier and I respectfully ask the Polda Metro Jaya to be able to give maximum results, because I asked to be SP3," he said.
"Why? Because I have never committed a false oath. I have never been present at the trial to swear, but instead I was criminalized, at the Ministry of Law and Human Rights of the Republic of Indonesia, I have given a recommendation to the Chief of Police who previously requested that it be proven immediately or in SP3. Why? Because of the alleged human rights violations against me. I just want to defend my rights, which unit but it has not yet been submitted," continued Ike Farida.
