Yusril Affirms Rights To Not Be Able To Disrupt The Results Of The 2024 Presidential Election
JAKARTA - Constitutional law expert Yusril Ihza Mahendra emphasized that the right of inquiry proposed by a number of parties regarding the alleged fraud in the 2024 General Election could not thwart the results of the 2024 presidential election. According to Yusril, only the decision of the Constitutional Court (MK) could be canceled.
"No (can we cancel the election results), it can't be if the election results have been decided by the Constitutional Court (Mahkamah Konstitusi). It will be a question mark for me if there is no Constitutional Court decision," Yusril told reporters, Thursday, February 22.
Not to mention, said Yusril, the investigation into the DPR's right to inquiry took a long time. Meanwhile, the term of office of the president and vice president now ends on October 20, 2024.
"There is also a problem if this is prolonged because the inquiry investigation will take time. Meanwhile, the presidential term has expired on October 20 and this must be a new president. Otherwise, the country could be chaotic," said Yusril.
The establishment of the right to inquiry, said Yusril, must also receive support from the majority of DPR members. The results of the right to inquiry, he said, are in the form of recommendations from the DPR and cannot invalidate the election results.
"It is possible that the DPR will investigate this as long as it is supported by the majority of members of the DPR and of course the length of the budget process will be. Whatever the results later, it will be in the form of a recommendation from the DPR. Whatever the recommendation from the DPR, it will not invalidate the Constitutional Court's decision if the trial is carried out," explained Yusril.

Nevertheless, Yusril still respects the proposal from a number of parties including presidential candidate number 3, Ganjar Pranowo, who wants the DPR to use the right of inquiry to investigate allegations of election fraud.
"Yes, we respect that wish, well, and the inquiry already has provisions on the laws and regulations. Indeed, everything related to government policies can be carried out by the DPR, but there is the formation of the budget committee as regulated in the law," concluded Yusril.
