3 Defendants Of Corruption Of Central Maluku Disdik BOS Fund Sentenced To 4-5 Years In Prison, Including Kadisdik

The Ambon Corruption Court of Judges sentenced three defendants to corruption in school operational assistance funds (BOS) at the Central Maluku Regency Education Office (Disdik) for the 2020-2022 budget year which cost the state Rp3.9 billion.

"To declare the defendants guilty of violating Article 2 Juncto Article 18 of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning Corruption Crimes as a primary indictment," said Chairman of the Ambon Corruption Court, Haris Tewa accompanied by two member judges in a trial at the Ambon District Court, Monday, February 19, confiscated by Antara.

The defendant Askam Tuasikal, who is the Head of the Central Maluku Education and Culture Office (Kadisdik), was sentenced to five years in prison and a fine of Rp. 300 million, subsidiary to three months in prison.

The defendant was also sentenced to pay a replacement money of Rp3.9 billion which was reduced by the money confiscated from the defendant Askam, Oktovianus Noya and the defendant Munaidin Yasin amounting to Rp124 million.

So that the remaining state financial losses amounted to Rp3.8 billion which were divided evenly and became the responsibility of the defendants. Thus, Askam Tuasical is charged with paying compensation of Rp1.8 billion, subsidiary to one year in prison.

Then the defendant Oktovianus Noya was sentenced to four years in prison, a fine of Rp. 300 million, subsidiary to three months in prison, and to pay compensation of Rp. 371 million after deducting the return of Rp. 15 million and Rp. 124 million.

"If within one month after this decision has permanent legal force and no replacement money is paid, the defendant will be subject to an additional sentence of one year in prison," said the panel of judges.

Then, the defendant Munaidin Yasin was sentenced to five years in prison and a fine of Rp. 300 million, subsidiary to three months in prison and compensation of Rp. 1.5 years in prison, subsidiary to one year in prison.

What burdens the defendants is being sentenced to prison because specifically for the defendants Askam and Oktovianus who are State Civil Servants do not support the government's program in efforts to eradicate corruption.

Meanwhile, the mitigating thing is that the defendants are polite and have never been punished.

Based on the judge's decision, the Central Maluku Prosecutor's Office, Junita Sahetapy, and the defendants through their legal advisory team, expressed their thoughts.

In the previous trial, the Public Prosecutor demanded that the defendant Askam be imprisoned for eight years, a fine of Rp. 600 million, subsidiary to six months in prison and compensation of Rp. 1.8 billion, subsidiary to four years in prison.

Then the defendant Oktovianus was sentenced to seven years in prison, a fine of Rp. 300 million, subsidiary to six months in prison and compensation of Rp. 589 million, subsidiary to three years and six months in prison.

Meanwhile, the defendant Totalidi Yasin was sentenced to seven years in prison, a fine of Rp. 300 million, subsidiary to six months in prison and compensation of Rp. 1.5 billion, subsidiary to three years and eight months in prison.
