Former Head Of Mineral And Coal ESDM NTB Sentenced To 5 Years In Iron Sand Corruption Case
The panel of judges who tried the corruption case of the iron sand mine in the Dedalpak Block, East Lombok Regency, sentenced the former Head of Mineral and Coal for the Energy Office of West Nusa Tenggara Mineral Resources, Syamsul Makrif.
"The trial was by imposing a prison sentence on the defendant Syamsul Makrif with a sentence of 5 years," said Chief Justice Mukhlassuddin when reading out Syamsul Makrif's verdict in a trial at the Corruption Court at the Mataram District Court as reported by ANTARA, Tuesday, February 13.
In addition to criminal penalties, the judge also stipulated a fine of Rp. 200 million, subsidiary to 2 months in prison.
The judge handed down the crime by stating that the defendant had been proven to have participated in a criminal act of corruption jointly related to the activities of PT Anugrah Mitra Graha (AMG) carrying out iron sand mining in the Dedalpak Block for the period 2021 to 2022 without obtaining a letter of approval for the planned budget activity (RKAB) from the Ministry of Energy and Mineral Resources.

One of the judge's considerations stated this by looking at the facts of the trial from Syamsul Makrif's statement claiming to have signed a statement letter for a company running an iron sand mining business in the Dedalpak Block, namely PT AMG without confirmation with its superiors, the Head of the West Nusa Tenggara Energy and Mineral Resources Service (ESDM), which at that time was held by Muhammad Husni.
By looking at this fact, the judge determined that the defendant's actions violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1 of the Criminal Code in accordance with the first indictment of the primary public prosecutor.
"Turut menetapkan terdakwa tetap berada dalam penjabatan," ujarnya.
Previously, the prosecutor in charge asked the judge to sentence the defendant Syamsul Makrif to 10 years in prison with a fine of Rp. 500 million, subsidiary to 6 months in prison.
