Perpetrators Of Obscenity Of The Same Type In Maluku Sued 10 Years In Prison

AMBON - Public Prosecutor of the Ambon District Attorney's Office, Inggird Louhenapessy, charged Jesika Janyan, a defendant with alleged sexual abuse of same-sex, for 10 years in prison.

"Asking the panel of judges who examined and tried this case to declare the defendant guilty of violating Article 82 paragraph (1) of Law Number 17 of 2016 concerning the Determination of Perppu Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection Juncto Article 64 paragraph (1) of the Criminal Code," said the Public Prosecutor in a hearing at the Ambon District Court, reported by ANTARA, Wednesday, January 17.

The demands were conveyed in a trial led by the Chairman of the Ambon District Court, Orpha Maitimu and accompanied by Rahmat Selang and Novi Salmon as member judges.

In the prosecutor's letter of demand, the defendant was also sentenced to pay a fine of Rp. 60 million, subsidiary to six months in prison.

What burdens the defendant is being charged with imprisonment and fines because his actions have resulted in the victim and his family being ashamed of the community, and his actions have influenced children to date same-sex.

Meanwhile, the mitigating factor is that the defendant has never been convicted and admitted his actions.

The defendant in June 2023 became acquainted with the victim with the initials KK who was 16 years old, then asked her to date via text message.

"Furthermore, the defendant held several meetings with the victim around the beach and the Passo Country mangrove forest, Baguala District (Ambon City) between June and July 2023," said the Public Prosecutor.

During the meeting, the defendant molested the victim continuously and the victim did not attend school for several days until the teacher at school called the victim's parents.

"These two similar couples were raided by the victim's father and uncle when they fled their homes and slept in the mangrove forest, then the defendant was reminded not to approach the victim again," explained the prosecutor.

The panel of judges postponed the trial until next week with the agenda of hearing the defense of the defendant and his legal advisers.
