Mahfud MD Affirms TIP Perpetrators Do Not Have The Right To Receive Restorative Justice
Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD emphasized that every party involved in the crime of trafficking in persons (TPPO) has no right to receive restorative justice or restorative justice. The reason is that TIP is considered a serious crime.
Mahfud explained that restorative justice is only intended for criminal acts that are considered as small as the impact of losses or minor crimes (tipiring) so that they can be resolved in a peaceful manner between the perpetrator and the victim.
"There is no peace in the trade crime, it is a serious crime, it must be thrown into the prison of the perpetrators," he said while attending Migrant Day in Depok, West Java, Wednesday, December 20, which was confiscated by Antara.
Menurut Mahfud, keadilan restorative merupakan warisan budaya hukum masyarakat Indonesia yang menyelesaikan masalah secara musyawarah dengan melibatkan kepala adat.
If it is related to the modern era of restorative justice, it can be given, for example, to the perpetrators of spreading good names, traffic violators.
This is because the threat of punishment for perpetrators of defamation in general is only a matter of months because it is not life-threatening, as well as traffic violators.
"Well, but if there is a big crime, money laundering, trafficking in persons, corruption, premeditated murder, smuggling, there is no restorative justice there, it must be processed to court," he said again.

Therefore, Mahfud hopes that the victims of TIP can also firmly reject the completion of the peaceful path by the perpetrators even though they are promised a large amount of money in return.
