Kejari Execution Ke Lapas 2 Terdakwa Korupsi Alat Metrologi Disperindag Dompu NTB

NTB - The Dompu District Attorney (Kejari) executed two defendants in a corruption case in the procurement of metrology tools at the Department of Industry and Trade (Disperindag) of Dompu Regency, West Nusa Tenggara (NTB).

The two of them are technical implementing officials for the procurement of the Disperindag Dompu metrology tool, which serves as Head of the Trade Division of the Dompu Disperindag, Iskandar and project implementer from CV Fahriza, Yanrik. Iskandar was sentenced to 1 year and 5 months, while Yanrik was 1 year and 2 months in prison.

"So, we carried out the execution of our detention in accordance with the court's decision which has the status of an inkrah. Both of them are undergoing detention at the Class II A Prison in West Lombok," said Head of the Intelligence Section of the Dompu Kejari Joni Eko Waluyo by telephone, Friday, December 15, as reported by Antara.

The decision with inkrah status is the result of a trial at the first instance court.

The two convicts and public prosecutors (JPU) did not file further legal remedies until the time limit set by the panel of judges.

"So, the decision was inkrah because the two convicts and the prosecutor did not file further legal remedies," he said.

In the first instance court decision, Chief Justice I Ketut Somanasa stated that Iskandar was found guilty of committing a criminal act of participating in corruption as stated in the indictment of a subsidiary public prosecutor.

The indictment relates to Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code.

With this decision, the panel of judges sentenced Iskandar to 1 year and 5 months in prison and a fine of Rp. 100 million, subsidiary to 4 months in prison.

For Yanrik, the panel of judges sentenced him to 1 year and 2 months in prison with a fine of Rp. 50 million, subsidiary to 3 months in prison, stating that his actions had been proven to have violated the public prosecutor's subsidiary charges.

The judge in the decision also charged Yanrik with paying compensation for state financial losses worth Rp135 million, subsidiary to 6 months in prison.

The value of the loss is only borne by Yanrik because he is the party enriched in this case.

The panel of judges explained that the Rp135 million was the remainder of the state financial losses resulting from the audit of the NTB Inspectorate worth Rp398 million which had not been paid.

For Rp263 million, it has become a note for the public prosecutor as money deposited to recover state financial losses at the investigation and prosecution stages.

With this elaboration, the panel of judges determined that the refund of Rp263 million was confiscated by the state to recover state financial losses.

The implementation of the procurement of metrology tools complete with other facilities and infrastructure runs using the Dompu APBD for the 2018 budget year worth IDR 1.42 billion.

The procurement was carried out by Yanrik who received the power of attorney as project implementer from CV Fahriza, who is based in Dompu Regency.
