Regarding Conflict Of Interest In The Constitutional Court, PDIP Secretary General: Can Be Categorized As A Political Tsunami
JAKARTA - Secretary General (Secretary General) of the PDI-P (PDIP) Hasto Kristiyanto poked at Anwar Usman who was proven to have violated serious ethics related to conflicts of interest in the Constitutional Court's decision regarding the requirements for the age of presidential and vice-presidential candidates to be changed to 40 years or has experience being a regional head.
Hasto considered that the leader should not be one-sided. This was said by Hasto when he started his speech at the Ma'mun Murod Professor's Inauguration at the University of Muhammadiyah Jakarta (UMJ), Ciputat, South Tangerang.
"If you become a wise and kind leader, it is Prof. Haedar Nashir, thank you. Also Mr. Muhaimin Iskandar, thank you, the campaign may be Cak Imin here. The important thing is not to carry out legal engineering at the Constitutional Court," said Hasto in his speech at UMJ, Ciputat, South Tangerang, Thursday, November 9.
Hasto assessed that what happened had damaged the disappointment of the constitutional guard institution which should not have lost its independence in handling cases, including adjudicating a lawsuit related to the general election. That can actually be categorized as a political tsunami, because this Constitutional Court must be a bulwark of the constitution, a bulwark of Democracy," he said.
On that basis, according to Hasto, what the Constitutional Court had previously decided regarding the requirements for the age of the presidential and vice-presidential candidates to touch the validity of Gibran Rakabuming Raka as a candidate for cawapes not yet 40 years old to accompany Prabowo Subianto in the 2024 presidential election.
"Violating ethics seriously, it is even proven that the interference of power from outside is not at all justified and this touches on issues related to the validity of the pair Pak Prabowo and Mas Gibran," he said.
As is known, the Constitutional Court granted the judicial review lawsuit Article 169 letter q of Law Number 7 of 2017 concerning General Election regarding the terms of age for presidential and vice presidential candidates at least 40 years old proposed by a student named Almas Tsaqibbirru Re A.
The case Number 90/PUU-XXI/2023 requested by Almas asked the Constitutional Court to change the nomination requirements for presidential and vice-presidential candidates to a minimum of 40 years or experience being a regional head.
This also continues to be a public debate and is considered to have a conflict of interest, until the Constitutional Court finally formed the Makamah Constitutional Council (MKMK). Over time, based on an ethics trial, the Constitutional Court decided to dismiss Anwar Usman from the position of Chief Justice of the Constitutional Court.
MKMK chairman Jimly Asshidiqqie stated that Anwar Usman was proven to have committed serious violations of the code of ethics and behavior of the constituting judge as stated in Sapta Karsa Hutama, the principle of impartiality, the principle of integrity, the principle of competence and equality, the principle of independence, and the principle of appropriateness and decency.
"Imposing sanctions for dismissal from the position of Chief Justice of the Constitutional Court to the reported judge," said Jimly at the Constitutional Court building, Central Jakarta, Tuesday, November 7.
