Former Chairperson Of IDI Maluku Accused Of Corruption In Health Examination Funds For Candidates For Regional Heads Sued 3.5 Years In Prison
The Public Prosecutor (JPU) of the Maluku High Prosecutor's Office charged the defendant dr. Henderita Tuankotta, former Indonesian Doctors Association in the Maluku Region, for 3.5 years in prison in a case of alleged corruption and an administrative check-up (health check) for a candidate for regional head.
"Asking the panel of judges who examined and tried this case to declare the defendant guilty of violating Article 3 Juncto Article 18 paragraph (1), paragraph (2) and paragraph (3) of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the eradication of corruption Juncto Article 64 paragraph (1) of the Criminal Code," said Public Prosecutor Achmad Atamimi in Ambon as reported by ANTARA, Tuesday, September 19.
The prosecutor's claim was conveyed in a trial chaired by the Chief Justice of the Corruption Crime Council (Tipikor) at the Ambon District Court,Martha Maitimu, accompanied by two member judges.
"The defendant's actions as Chair of the Maluku Regional IDI received and managed the medical checkup (MCU) budget for the district/city and Maluku Province elections 2016-2020 and acted on his personal behalf, as if for IDI activities, was not in accordance with Article 6 AD/ART, namely IDI is a non-profit medical professional organization of national, independent, and non-profit," said Achmad.
The defendant's actions to request and collect from the regency and city and provincial KPUs of Maluku 2016-2020 to pay MCU fees, either by transfer through the IDI Maluku Region account, the RSUD account of dr. M. Haulussy or in cash to the defendant, which of which was handed over directly to his house, was contrary to the applicable legal provisions.
As a result of the defendant's actions in managing the MCU budget as well as managing and regulating the MCU process for regional head balloons and deputy regional heads of districts/cities and Maluku provinces in 2016-2020 in its implementation has resulted in state losses of Rp. 829,299 million.
This state financial loss is in accordance with the audit report on the calculation of state financial losses in the alleged corruption case by the BPKP RI Maluku Province Representative Number: PE.03.02/R/SP 1915/PW25/5/2022 dated October 24, 2022.

The defendant was also required to pay a fine of Rp. 50 million, a subsidiary of two months in prison and a replacement money of Rp. 829,299 million which was calculated with the money deposited with the public prosecutor and has been deposited into the account of the Ambon District Court RPL at Bank Mandiri in the amount of Rp. 44 million.
This Rp44 million is to cover the replacement money with provisions within one month after this decision has legal force, the remaining replacement money is not deposited into the state treasury, so its property can be confiscated for auction.
However, if it is not sufficient, the defendant will be subject to an additional sentence of 1.8 years in prison.
The panel of judges postponed the trial until next week with the agenda of hearing the defendant's defense through his legal adviser.
