MA Cancels The Eva-Deddy Winner's Disqualification, Now The Bandar Lampung Regional Election Lawsuit At MK Is Revoked
JAKARTA - The request for dispute over the results of the Bandar Lampung regional election submitted by the candidate pair for mayor-deputy mayor Muhammad Yusuf Kohar-Tulus Purnomo Wibowo is revoked.
In the 2020 Regional Election dispute trial, Constitutional Justice Suhartoyo asked for clarification from the applicant's attorney regarding the application withdrawal letter submitted on January 8, 2020.
"Even if the withdrawal of the petition is correct, Your Honor. This means that our principals ask us to withdraw the petition at the Constitutional Court," said the petitioner's attorney, Ahmad Handoko, quoted by Antara, Thursday, January 28.
In the petition submitted to the Constitutional Court, candidate pair number 2, Muhammad Yusuf Kohar-Tulus Purnomo Wibowo, requested the cancellation of the Bandar Lampung KPU decision which stipulated the vote acquisition for candidate pair number 3, Eva Dwiana-Deddy Amarullah, as many as 249,241 votes.
Meanwhile, the pair Muhammad Yusuf Kohar-Tulus Purnomo Wibowo has 93,280 votes, and pair number 1, Rycko Menoza-Johan Sulaiman, has 92,428 votes.
According to the Petitioner, there were allegations of vote mark-up for the Eva Dwiana-Deddy Amarullah pair, resulting in a significant difference in vote acquisition.
The next violation committed by Eva Dwiana-Deddy Amarullah which the petitioner argued was the mobilization of the Bandarlampung Government apparatus from the village head, sub-district heads, RT heads to Linmas to campaign for the pair, and the use of the Bandarlampung APBD in an effort to win.
It is suspected that the APBD was used in the form of providing basic food assistance packaged as COVID-19 assistance, providing incentives, and other assistance.
The Eva Dwiana-Deddy Amarullah pair were also said to have committed money politics during the campaign period and the calm period leading up to the voting in several urban villages.
Previously, the Lampung Province Bawaslu stated that the Eva Dwiana-Deddy Amarullah pair had committed a structured, systematic and massive violation (TSM), so the Bandarlampung KPU issued a decision to disqualify the pair.
Then the couple submitted a request to the Supreme Court (MA) to cancel the Bandar Lampung KPU decision and this was granted by the Supreme Court.
