Criminal Expert Reveals Shane Lukas' Involvement In The Case Of Persecution David Ozora, Like A Gang Of Robbers
JAKARTA - Criminal law expert from Bina Nusantara University (Binus), Ahmad Sofian, assessed that the defendant Shane Lukas had contributed to a series of cases of mistreatment of David Ozora by Mario Dandy Satriyo. In fact, his role is likened to a gang of robbers.
This view began when the Public Prosecutor (JPU) questioned whether or not the elements of Article 55 were included in someone who did not beat him in the persecution case.
"But at the time of the incident, this person did not do something, did not hit, did not kick, but did he have a role to look around, see, for example someone came, stopped someone coming, then stopped this main actor. Can such a context be included in Article 55 of the experts?" asked the prosecutor during a trial at the South Jakarta District Court, Tuesday, July 11.
Then, Ahmad said that the person's actions were included in the context of Article 55 of the Criminal Code. The reason is that there are concrete actions committed by each actor known as the factum.
"So, at the time of the fact of the act at the location there was a concrete act and the concrete act could be attributable as an unlawful act, the location of the crime scene," answered Ahmad.
The concrete contribution in question is like a person's support for other people so that they dare to commit a crime. It is likened to a gang of robbers who act not alone.
Although the perpetrator directly threatened or confiscated the victim's belongings, his colleague also contributed. For example, ensuring the situation and conditions are safe and so on.
"He needs friends to make sure that when he runsaway, he is safe," said Ahmad.
In this case, the defendant Mario Dandy Satriyo was charged with sadistic assaulting David Ozora. In fact, it caused serious injuries.

The prosecutor charged him with Article 355 paragraph 1 to 1 of the Criminal Code Junto Article 55 Paragraph 1 to 1 of the Criminal Code and a subsidiary of Article 355 paragraph 2 in conjunction with Article 55 paragraph 1 to 1 of the primary Criminal Code with Article 355 paragraph 1 to 1 of the Criminal Code in conjunction with the 2nd Criminal Code.
