LaNyalla Emphasized That If The Group Envoy Wants To Be Returned, Must Return To The 1945 Constitution
BOGOR - Constitutional changes made from 1999 to 2002 have removed the representation of class representatives in the People's Consultative Assembly (MPR) as the highest state institution. According to the Chairman of the DPD RI, AA LaNyalla Mahmud Mattalitti, if you want the Group Envoy to be presented again, one way is to return to the original text of the 1945 Constitution.
"Filling out group envoys without returning to the original text of the 1945 Constitution will have no meaning," said LaNyalla in a Focus Group Discussion (FGD) organized by the Pembangunan Nusantara Foundation at the Balai Kirti Museum, Bogor Presidential Palace, Sunday, January 15.
Pancasila Values
LaNyalla explained that the Constitution as a result of amendments in 1999 to 2002 had abandoned Pancasila values. "Pancasila is no longer reflected in the Articles which have been amended 95 percent more than the original text. So that the construction of a state system formulated by the founders of the nation has disbanded," said LaNyalla.
The senator from East Java continued, what happened was that the Constitution as a result of the amendment during the Reformation actually outlined other values, namely the ideology of Liberalism and Individualism.
LaNyalla said, at that time the Western narratives that were presented were the antithesis of the New Order Era. In fact, the practices that occurred in the New Order Era were deviations from the expectations and formulas for an ideal state system compiled by the founding fathers of the nation.
"The nation's founding fathers clearly did not want a Trias Politica system or a separation of powers. Instead, they concentrated power in the Highest Institution of the State which is the embodiment of the people, so that sovereignty is truly in the hands of the people," said LaNyalla in a written statement received by the editorial team.
The Best
According to LaNyalla, the highest state institution is not only filled through elections, but also filled through envoys. In fact, LaNyalla said that Pancasila democracy is the best system that has ever existed in the world.
"If today we talk about Group Representatives, then we should be talking in full about the state system that was formulated by the founding fathers of the nation," said LaNyalla.
Therefore, LaNyalla emphasized the importance of the representation of group envoys in the MPR to strengthen people's sovereignty. This is because Pancasila democracy is the only separate system in the world.
"Only the Pancasila democratic system has the Highest Institution capable of accommodating all elements of the nation as part of the incarnation of the people," emphasized AA LaNyalla Mahmud Mattalitti.
He explained, the elected representatives are participants in the General Election. While the representatives who were sent were those who were carried and given the mandate by their group. That way, there will be two delegates consisting of Regional Envoys and Group Envoys.
"Regional Envoys, namely those who are regional figures or the Kings and Sultans of the Archipelago. Meanwhile, Group Envoys are those who consist of organizers and professionals who are active in their fields," explained LaNyalla.
Return
According to him, this effort can be done by returning the original text of the 1945 Constitution, to then amend and perfect the weaknesses with an addendum technique. Of course without changing the state system.
"That is what I am now offering to this nation. Let's correct the weaknesses in the original text of our constitution. But don't completely change the construction of a state that has been formulated by the founding fathers of the nation," said LaNyalla.
One of them, we can strengthen by emphasizing how to fill the Regional Envoys and Group Envoys. The goal is that we don't repeat the wrong practices in the New Order era, where the envoy was appointed by the president.
"We can strengthen the role of the DPR by including election participants from two elements, namely elements of political parties who are political representatives, and election participants from individual elements who represent regions or regional representatives," explained LaNyalla.
