Continuation Of Obstruction Of Justice Baiquni Wibowo And Chuck Putranto Trials To Be Decided Today
JAKARTA - The panel of judges at the South Jakarta District Court will read out a decision on the exception or memorandum of objection filed by defendants Baiquni Wibowo and Chuck Putranto in the obstruction of justice case.
The decision will later determine whether or not the process of proving all the indictments that have been prepared by the Public Prosecutor (JPU) will continue.
"Yes, that's right, today's trial agenda for defendants BW and CP is an interim decision," said Public Relations of the South Jakarta District Court, Djuyamto to VOI, Thursday, November 10.
At the previous trial, the defendant Baiquni Wibowo in his exception stated that what he did in his capacity as Head of the Ethics Enforcement Section of the Profession Bureau of Propam Division of National Police, was the executor on orders from his superior, Ferdy Sambo.
"So as long as it can be proven that the government apparatus with the executor status carries out its duties and functions because it is only based on limited information and is motivated by decisions and/or actions that are authority judgment (assessment of the position of direct superiors), in an official relationship that must be carried out and obeyed, then this "This factual matter is not the responsibility and fault of the implementing government apparatus, but is entirely on the responsibility and fault of the implementing government apparatus, which was accepted and carried out by the accused brother Baiquni Wibowo," the attorney explained when reading the exception.

Not much different, Chuck Putranto also in his exception stated that he only carried out orders from superiors in the case of Brigadier J.
There are a number of legal grounds that strengthen what the defendant Baiquni did. For example, Law Number 25 of 2009 concerning Public Services, Regulation of the State Police Number 7 of 2022 concerning the Code of Professional Ethics and the Commission on the Code of Ethics of the Indonesian National Police (Perpol 7/2022), Perkapolri Number 6 of 2017.
Baiquni Wibowo and Chuck Putranto were charged with obstructing the investigation into the murder of Nopriansyah Yosua Hutabarat alias Brigadier J.
He is said to have conspired with Ferdy Sambo, Hendra Kurniawan, Agus Nurpatria, Baiquni Wibowo, Irfan Widyanto and Arif Rachman.
In addition, in obstructing the investigation process, Chuck, who held the rank of Kompol at that time, was said to have secured and copied the CCTV DVR data installed at the Police Complex, Duren Tiga.
Thus, he was charged with violating Article 49 in conjunction with Article 33 subsidiary Article 48 paragraph (1) in conjunction with Article 32 paragraph (1) of the ITE Law Number 19 of 2016 and/or Article 233 of the Criminal Code subsidiary Article 221 paragraph (1) to 2 in conjunction with Article 55 of the Criminal Code.
