Differences In Pre-Reconstruction And Reconstruction And Examples Of Implementation In Criminal Cases

YOGYAKARTA In the investigation, the term pre-reconstruction and reconstruction is known. Both of them did sound the same. However, there is a difference between pre-reconstruction and reconstruction in a criminal case. In fact, both were held in the latest case, namely the shooting of Brigadier J involving Inspector General Ferdy Sambo.

It should be noted that the reconstruction is regulated in the SK of the National Police Chief 1205/2000. In Chapter III number 8.3.dSK, the National Police Chief 1205/2000 said that the inspection method can be carried out with four techniques, namely interviews, interrogations, confrontations, and reconstruction. Thus, in general, it can be said that reconstruction is one of the techniques of examination in investigating criminal cases.

In the Big Indonesian Dictionary (KBBI), reconstruction has two meanings. The first understanding is the return as before, while the second meaning is the preparation (image) again.

Quoted from Online Law, Merry Chrystin Silaen through an article entitled Reconstruction Extension in Criminal Case Evidence explained that reconstruction is one of the examination techniques in the context of investigation. This technique is carried out by demonstrating again how the suspect commits a crime or knowledge of witnesses.

The purpose of the reconstruction is to get a clear picture of how the crime is taking place. In addition, the reconstruction aims to test the truth of the information and testimonies from all parties, including the perpetrator and the witness.

Juda Trisno Tampubolon through an article entitled Regulation of Reconstruction as Evidence in the Investigation Process (Student in the Pontianak Police Legal Region) explained that before the reconstruction was carried out which was attended by the public prosecutor (JPU) and legal advisers from the suspect, investigators first held a pre-reconstruction.

Pre-reconstruction was held behind closed doors and held at the examination site when the suspect and the witness gave their statements to investigators.

An example of a criminal case that applied pre-reconstruction and reconstruction was the shooting of Brigadier J involving Inspector General Ferdy Sambo. This was explained by the Head of the Public Relations Division of the National Police Inspector General Dedi Prasetyo to reporters in South Jakarta, Saturday, July 23.

Quoted from Detik, Inspector General Dedi Prasetyo explained that the pre-reconstruction of the case of the death of Brigadier Yoshua was held at the house of Inspector General Ferdy Sambo. He also explained the pre-reconstruction understanding carried out by investigators.

"If the pre-reconstruction must have a substitute role, yes, the replacement role is in accordance with the results of the statements of the witnesses and the findings from the Labfor team, Inafis, the Docpol were combined," he said, quoted on Tuesday, August 30.

Pre-reconstruction was also held at Polda Metro Jaya on Friday, July 22. Pre-reconstruction results were then matched with the actual crime scene which was used as a provision for reconstruction at the house of Inspector General Ferdy Sambo.

The Reconstruction of Brigadier J's own shooting was held on Tuesday, August 30, 2022, in three locations with 78 scenes re-recorded by the suspects, including Inspector General Ferdy Sambo. This information was as stated by the Director of General Crimes at the National Police Criminal Investigation Agency Brigadier General Andi Rian Djajadi.

"Re-recauble activities include events that occurred at Magelang's house, Saguling's house and Duren Tiga's house covering 78 scenes," explained Brigadier General Andi Rian Djajadi to VOI, Tuesday, August 30.

That is the difference in pre-reconstruction and reconstruction in criminal cases. Both were also applied in the shooting case of Brigadier J involving Inspector General Ferdy Sambo. To get other interesting information, visit VOI.ID.
