Former Head Of Bandung City Service Herry Nurhayat Sentenced To 4 Years In Prison For RTH Corruption

JAKARTA - Former Head of the Regional Financial and Asset Management (DPKAD) Bandung City Herry Nurhayat was sentenced to four years in prison by the Bandung District Court (PN) Panel of Judges in a corruption case in the procurement of green open spaces (RTH).

Chairman of the Panel of Judges, T Benny Eko Supriyadi said that Herry Nurhayat's actions were proven legally and convincingly to have harmed the state from this corruption act.

"Herry Nurhayat legally convinced him to commit a criminal act of corruption together. Sentenced him to four years imprisonment with a fine of Rp.400 million, if he is unable to pay, he will be sentenced to six months in prison," said the Chief Judge at the Bandung District Court, reported by Antara, Wednesday, November 4.

The panel of judges assessed that Herry's actions were categorized as serious losses to the state. Because of that case, the state suffered a loss of around Rp.69 billion.

However, Herry's level of error, according to the panel of judges, was in the moderate category. What made Herry easier, according to the Judge, was being polite during the trial, and collaborating to uncover other figures involved in the case.

"In the category of heavy state losses, the sentence is 8 to 10 years. However, Herry is cooperative, willing to become a justice collaborator, who can expose other perpetrators," said the panel of judges.

In addition, Herry was also sentenced to have to pay replacement money of Rp1.4 billion. If not paid, Herry's property will be confiscated by the KPK prosecutor to meet the amount of replacement money.

"If the property does not meet the replacement money, Herry will add a sentence of one year in prison," he said.

Apart from Herry, there were two other defendants who played a role in the corruption, namely Tomtom Dabbul Qomar and Kadar Slamet who from 2009 to 2014 were members of the Bandung City DPRD.

They were charged with inflating the budget for the provision of green open space in Mandalajati and Cibiru districts, Bandung City.

The decision was in accordance with the alternative charges Article 3 of the Law on Corruption in conjunction with Article 55 in conjunction with Article 64 of the Criminal Code.
