Pros And Cons Of Advancing Ahok As Head Of BUMN

JAKARTA - The name Basuki Tjahaja Purnama alias Ahok or BTP is back in the public spotlight. This time he is reported to be one of the leaders of BUMN. This rumor has been circulating since his arrival at the BUMN Ministry office some time ago.

Shyly, Ahok admitted that he was asked by BUMN Minister Erick Thohir to contribute as a BUMN official. However, unfortunately he did not want to disclose what the position was offered.

Ahok's advancement as the leader of BUMN reaped the pros and cons. Questioned Ahok's status as a former prisoner. Some parties consider that in appointing a BUMN leader, they must also consider the track record of a person who will be appointed.

MPR Deputy Chairman Syarief Hasan said there are many criteria that must be considered, one of which concerns integrity issues. Even if this is the executive's authority.

"I only said that to become a government official there are many factors that are taken into consideration. One of the factors of integrity and behavior. After all, this concerns the problems of the nation and state," said Syarief, at the DPR Building, Parliament Complex, Senayan, Jakarta, Thursday, November 14. .

Syarief then touched on the question of prohibiting former corruptors from running in regional head elections. For him, the executive must be able to pay attention to this in appointing someone for the leadership of BUMN.

"There is already a view from the KPU that ex-convicts are not allowed, and that has already been done. So I am giving an example that state officials really have to be selective. It cannot be just because of their considerations from my supporters, or from my party, "he said.

Instead of rejecting Ahok, Syarief admitted that his party would still consider this issue. This is because the holder of power over the appointment of state leadership, in this case the leadership of BUMN, is the government.

"The factor of rejecting or not rejecting, we have to consider later, we will see how. We leave it to the executive, how do I want to emphasize that to elect public officials, factors are also taken into consideration," he explained.

Executive Director of the Institute for Development of Economics and Finance (INDEF) Tauhid Ahmad said there are three key criteria for appointing members of the board of directors or commissioners or the supervisory board.

"First, you must have integrity. Second, you must have experience and capability in the business sector. Third, what I think you need to see is the vision and mission of each candidate," he said when contacted by VOI.

Regarding the status of ex-convicts who can be appointed as members of the board of directors or commissioners or the supervisory board, Tauhid said that the crimes that are not permitted are those that are detrimental to the state.

"For example, members of the board of directors are appointed based on expertise, integrity, leadership, experience, honesty, good behavior, and high dedication. There are no criminal matters (SARA), only the interpretation of Article 45," he said.

Referring to Law No. 19/2003 on BUMN, Ahok could be the boss of a state company. Because in article 45 paragraph (1), the prohibition for someone to become a candidate for directors of BUMN is that they have committed a criminal act that has caused losses to the state.

The following reads the article:

"Those who can be appointed as members of the Board of Directors are individuals who are capable of carrying out legal acts and have never been declared bankrupt or have become members of the Board of Directors or Commissioners or the Supervisory Board who are found guilty of causing a company or Perum to be declared bankrupt or people who have never been convicted of committing a criminal act detrimental to state finances. "

This means that Ahok has indeed committed a criminal act because he was considered to defame religion. However, it seems that his mistake did not result in leakage of state treasury. So, it seems okay if Erick Thohir entrusts one of the BUMNs to Ahok. Because in terms of capability and integrity, Ahok has received a lot of recognition.

Tauhid explained that whether or not Ahok could become the leader of BUMN also depended on the fit and proper test. Moreover, it is about proving integrity, because it is related to the ethics of a high-ranking state official.

"Ex-convicts can become leaders of BUMN or not, depending on if, for example, in my opinion, it will become a record about integrity. If the integrity is doubtful, it would better need to be reviewed or it should not be elected first," he said.

You don't have to leave the PDIP

Meanwhile, the Chairman of the PDIP DPP Eriko Sotarduga explained that Ahok did not need to resign from his membership in the PDIP if he wanted to join a state-owned company. Ahok was just an ordinary cadre and was not part of the party management, so there was no need to resign from the PDIP.

"Those who are obliged to resign are the management, for example, if I become an executive, I will resign from the party management. But if I become part of the membership, that's fine," said Eriko.

If Ahok becomes one of the commissioners and directors in BUMN, then he must resign from the management or party members, as stipulated in the SOE Ministerial Regulation Number Per-02 / MBU / 02/2015 concerning Requirements and Procedures for Appointing and Dismissing Members of the Board of Commissioners. and the BUMN Supervisory Board.

Eriko explained that his party supports Ahok to become a leader in BUMN companies. PDIP is also willing to release Ahok from the PDIP membership as long as there are rules requiring the former governor of DKI Jakarta to resign from the party.

"Because for us a cadre is not determined by his membership but the steps of his actions and behavior. That is much more important than just a membership card but how to do the best for the people," he said.

Previously, the Presidential Special Staff for Communications, Fadjroel Rachman, said officials at BUMN were not allowed to join political parties. Ahok, who is currently a PDIP cadre, according to Fadjroel, must resign from his party membership.

"If you want to enter BUMN, you must resign. Because there is an integrity pact letter," said Fadjroel at the Presidential Palace Complex, Jakarta, Wednesday, November 13.

What BUMN is suitable for Ahok?

Deputy Chairman of Commission VI Martin Manurung assessed that Ahok's figure is more suitable to be in BUMN-BUMN whose policies directly touch or intersect with public services.

According to Manurung, Ahok is suitable to be placed in a BUMN that has not developed well. Like PLN or Garuda. This is because the two companies directly intersect with the public.

"So, if a BUMN is not in contact with the public, Pak Ahok's role is not felt there," he said.

"Or at the same time the BUMN that are still losing money is our pride. For example? Like Krakatau Still, it was our pride from the days of Pak Harto, but now it's so rich," he continued.
