JAKARTA - Commission III of the DPR has also highlighted the status of a suspect that was obtained by the village treasurer, Nurhayati, after reporting the alleged corruption case of the Village Head. Moreover, the question is the reason why the police said there was an unintentional element in determining Nurhayati's status. "Regarding the reason, the police said that the determination of Nurhayati's suspect status as an 'accidental' act, the fact is that this is a big question for all of us," said Pangeran Khairul Saleh, Tuesday, March 1.

Pangeran then mentioned the Supreme Court Circular No. 4 of 2011 concerning the Treatment of Criminal Whistleblowers (Whistleblowers) and Witnesses of Collaborating Perpetrators (Justice Collaborators) in Certain Criminal Acts. certain criminal acts that are serious in nature, such as corruption, and others must be protected," he said.

Then based on Law (UU) Number 31 of 1999 concerning the Eradication of Corruption Crimes in conjunction with Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes.

Basically, Pangeran said, the public can participate in assisting efforts to prevent and eradicate corruption. "Public participation is manifested, among others, in the form of the right to seek, obtain, and provide information on allegations of corruption (corruption reporting)," he added.

Therefore, Pangeran continued, when Nurhayati reported allegations of corruption, it could be categorized as a whistleblower which of course is the right and responsibility of the community in preventing and eradicating corruption.

Meanwhile, specifically regarding defamation regulated in Chapter XVI concerning Humiliation contained in Articles 310 to 321 of the Criminal Code (KUHP) it cannot be directly applied based on Article 2 paragraph (2) letter e jo.
